Kilrush Town Council forced to pay out following unauthorised dumping incident

    County Clare, IRELAND, Sept 21st, 2006 –Clare County Council has required Kilrush Town Council to pay out EUR2580 arising from an incident last May whereby waste was inappropriately disposed of on the outskirts of the west Clare town. It is understood that the material in question - a mixture of soil, stone and various wastes - was buried on council lands after it was found that it could not be segregated for recycling at the local Lisdeen Transfer Station. The waste was later removed by the Town Council and disposed of at the Central Waste Management Facility at Ballyduff Beg.

    The Environment Section of Clare County Council confirmed today (Thursday, Sept 21st, 2006) that the payment, which included a fine under the Litter Pollution Act 1997, was imposed having “regard to the prompt and appropriate action taken by Kilrush Town Council to address the issue”. Kilrush Town Council removed the material within a week of receiving a complaint from a member of the public. It has already conducted an investigation into how the waste was inappropriately disposed of and has acknowledged that the incident should not have happened in the first instance. Kilrush Town Council’s policy on waste has since been communicated to employees at all grades and levels.

    Ger Dollard, Director of Services, Clare County Council said, “Clare County Council’s dedicated multi-disciplinary Waste Management Enforcement Team, which was established in May 2004, continues to police and prosecute breaches of the Waste Management Acts. The Local Authority views the illegal disposal of waste as inexcusable considering there are four Recycling Centres, including two Transfer Stations, 54 Recycling Bring Banks and a Central Waste Management Facility located in County Clare.”

    Councillor Patricia McCarthy, Chairperson of Environment and Emergency Services and Consumer Protection Strategic Policy Committee has welcomed Clare County Council’s handling of the case. “This incident demonstrates Clare County Council’s commitment to following up on all instances of illegal dumping. We need to continue to seriously tackle such illegal activity and it is imperative that the local authorities set an example in this regard. I am glad that Kilrush Town Council faced up to its responsibilities immediately and has paid the fine and other charges imposed by Clare County Council.”
