Pornography, Credit Cards and the Law

    Hello Everybody,

    I have a quick question about finding info on the legal position on accessing pornography by credit card from Ireland, nothing dodgy, just top shelf newsagent stuff.

    I have searched far and wide but cant find anywhere this question is addressed on sites like www.iab.ie and such.

    Does anyone know how to find out without having to hire a solicitor? Any information greatly appreciated.

    Complete guess here, but at a I would say that paying for pornography via credit card (be it for access to a porn site, buying magazines, or ordered DVDs) would be the equivalent of importing the stuff for your own private use.

    Stuff that's specifically outlawed would make buying it illegal, but for anything else, afaik the law the is in a grey area. For all intents and purposes, it would only be illegal if someone complained about the material, and a court decided that it contravened decency laws.

    I guess it makes sense that if you can buy it in a shop in ireland for cash, buying on the net by credit card wouldnt be any different.

    I have seen on the www.justice.ie website that it seems internet stuff like porn is divided into two categories, illegal or harmful.

    One example given is that while the Video Recordings Act 1989 doesnt mention the internet, it can cover videos downloaded from the internet.

    I wont attempt to summarise that info, but here is a link to a Department of Justice PDF document with a lot of information on this topic.
