i've always wondered this aswell and the only two cases i can come up with are:

1. they are step brothers (ie. have the same mom) michael taking his step-father's name - he seems like he would more so than lincoln - and lincoln staying with his father's name.

2. one of them is using their mother's maiden name again possibly could be michael.

there's probably a definite answer but i haven't heard it.

I always figured it was because Michael needed to be put in the same prison as his brother and it would've been slightly suspicious to have the same surname.
