How do I approach the subject of legal action with my current employer, to future employers or recruitment agencies?

It is hard to say without knowing the nature of the action.

As it is not something that you are obliged to disclose to a prospective employer or agency - I would probably not say anything. Why would you want to tell them?

Ok I follow, I don't have to tell them so do I just lie when they ask why I've left?

What about a reference from my current employer? I'm there 2 years.

You don't have to lie. You could be economical with the truth is saying something along the lines of "I had a difference of opinion with management."
As you haven't given any further info regarding the nature of the action (e.g., bullying/intimidation, unfair work practices, constructive dismissal, etc.) it is hard to offer more concrete advice.

You're taking legal action against them. What do you expect? Rightly or wrongly, from your previous employer's perspective you would not be someone that they would recommend. Do you know any other accountants who could give you one?

you can give other reasons besides the main one, lets face it you would have to be 100 times better than the next best person to get chosen over someone who has no potential issues like that. they are unlikely to give you a bad reference as it is very risky for them. they may not talk you up but they aren't going to say anything that could end up in court.

could you get someone that you are still on good terms with to be your reference?

Thanks for the advice. It's in my solicitor's hands at the moment so hopefully a resolution is arrived at soon.
