Machine Readable good enough for US?

Booked the holiday, (luckily) decided to check our passports (despite both being advised they were okay for US when they were issued).

Mine is okay - girlfriend's has not got a digital photo but a laminated one. Both are machine-readable.

    The US embassy website http://www.dhs.gov/dhspublic/interapp/content_multi_image/content_multi_image_0021.xml

suggests that passports issued after a certain date need a digital photo or a VISA.

My g/f was told she doesn't need a VISA - machine readable passport is good enough. She's been told this by US embassy security staff.

    Does this mean:

    a) she needs to go back and insist that she needs a visa.
    b) this is the law and will only be enforced when the necessary training programme has been fully implemented.
    c) its all a conspiracy with Aer Lingus, Delta, AA etc.???

Seriously does anyone know? Has anyone travelled to the US with a machine-readable passport with laminated photo issued after 26/10/05?
(specifically with passport from Visa waiver countries)

No machine readable ones are fine, you will be photographed and finger printed either in Dublin if you are going direct or when you land in your destination if going via a stopover. You'll be fine.
