    Sorry Mods if this is in the wrong place, but I didn't know where to post.

    Basically, my mother has some land in a town in the midlands, it's attached to the house that she's living in. There's a fairly large garden attached to it, and she's got into a bit of bother with the neighbour. My mother knocked a bit of a wall down to gain access to the garden, any way the neighbour has sent a letter complaining and threating to bring her to court.

    My mother wants to find out who owns the wall and if she has the right to knock it etc.

    The problem is she can't find the deeds to the garden, we own it, but have no real proof. The land has been in her mother family for hundreds of years (so afaik they'll be no record in the new system, a Folio I think is what it's called)

    I had a search on oasis.gov.ie to see if there's any info. But it all seems to refer to recent enough transactions etc. Does any one know how far back land registry records in Ireland go?

    My mothers a bit worried aboutt he whole thing, so I thought I'd ask here. I'd go into the registry office, but I'm in England, and she's in France for the next three weeks, so I thought I could get some info here.

    i don't know about the internet, but your local town/ county council should have the information you need.

    They go back years. Check out this site.

    You might have to go the office (either Dublin or Waterford) to pick it out on a map but this is easier than it sounds. It only costs a few €. Best of luck.

    Did the 1901 census go into that much detail? That'd be my guess.

    I'd be very surprised if the land registry details are accurate enough for the sort of thing you are looking for. Had an issue over a similar sort of thing a while ago regarding property built in the 1950s and the lack of proper detail in the records was astounding.

    TBH the whole area of boundaries and property law is a complete nightmare, I strongly advise you to do all possible to avoid going to court over it.

    If the garden has been held in the family for more than 12 years then though adverse posession it is hers anyway. Where is the wall? Between the garden and a public road?


    The land registry is electronic now, and your local land registry office will do a search and print out the Folio for €5. If the land is unregistered it may have a mention in the registry of deeds. Either way, there should be no issue about ownership.

    haha if only it was all that simple. Adverse possesion is a has loads of exceptions..

    Usually the neat side of a wall (ie flat side) faces out so if there was buttreses or other supports they would usually be on the side of the owner. The land registry most likely wont tell you who owns the wall but it may tell u if u own the garden or not.

    same thing happened to our family a while ago, land in the family for years, no deeds. The way we got it back was to prove that someone in our family paid the rates on it back in the 1940s thus making our claim on it. I would check out who has paid rates on the land as well. Your concil should have records of the rates

    Where is the property? There are a number of different land registeries, each of which deal with different parts of the country I believe.
