Yea, they've been mulling it over for a while. DRI is mostly lawyers or paralegals interested in the issue.

Actually it is important (IMO) as they are trying to limit powers that McDowall loaded into law in the dail as an 'add-on' to another piece of legislation requiring the telcos to keep phone data for up to three years in case the Guards need it. The EU 'rules' which were pushed through post 9/11 only require two years and Mc D is suing the EU to increase this!!

Overall, there is almost no supervision of the Guards on the matter, despite the supposed controls. The Gs can get their hands on the data fairly easily. In a recent case there was a leak (from the Gs?) to the Herald that one of the Afghanis in St Pats Cathedral was getting his instructions from Afghanistan!! information the Herald said they got from mobile phone calls.....

Undoubtedly the data could be useful, apparently it was used in the Veronica Guerin case.... but the DRI people feel the controls are insufficient, they have asked for further clarifications and were ignored so they are going to sue under privacy law and it being agin the Constitution...The Data Commissioner has several times said it is un-Constitutional.... watch the space, McD versus other lawyers....

    Bye, Barry

As far as I can see, the Veronica Guerin investigation would not have required the use of three-year-old data, although it did use mobile phone data.

Digital Rights Ireland is definitely not arguing that mobile phone records should not be used to prosecute criminals. What we are saying is that the government should not keep years of records about people who are suspected of no crime.

We are progressing our challenge, but we could do with your help to get the word out about what we are doing.
