    It sounds very vague whether or not he has a mental illness; what makes you think he has?
    If he has an "illness", I don't know, but I doubt you could sue as it may not have been intentional. IMHO I don't think it would be worth sueing, have you talked to him about it.

    If in your words he has a mental illness i presume your brother doesn't realise he did wrong, so why exactly do you want to take your mentally challenged brother to court? Are you that tightarsed or something?

    By the way, sorry to hear about your new elecy toothbrush, that must have been a sad day in your life, i hope you get through these trying times.

    You could take him to the small claims court, and represent yourself.
    But I find there are much better ways to get back at family members other than resort to petty legal solutions. Use your imagination... Youre brothers: bin his CD collection, tell his mates he's gay, hide his dog and tell him the corpo' took im.

    But whatever you do for God's sake... Dont fall out.

    OP, some of your statements are rather vague, but do you really want to stand in front of a judge and say "My brother is not all there, but I want to screw €600 out of him, even if he doesn't have it".

    Yes, you feel hurt, but it seems your hurt is less than your brother's problem.

    An aside, but what stage is your brother at?

    The Smalls Claim Court is always a cheap option.
    But if youre angry, there are healthier ways of venting your anger without causing a permanent rift.
    You dont really want to fall out with your brother.
