Lost baggage - AerLingus

(orig posted in consumer issues, but was told I could have better luck here)

Hi typical lost baggage situation, what happens now?

It was with AerLingus from Barcelona to Dublin direct. We landed at 2pm yesterday so technically the bag has been missing for 20 hours now.. they said that it would 90% be guaranteed on either of the two following flights that were leaving yesterday. So obviously there has been no word - therefore I can presume that the bag is gone.

I have a number and a reference number which I will use in a bit - I just wanted to know what is the 'most savy' way of going about this. I can imagine that they'd offer compo of like €200 or something paltry like that. I'm not looking to extort, but I do want either my stuff back or the exact value of what was lost.

    Please help..

    Depressed :(

Since 1936 air passengers’ luggage has been afforded protection under the Warsaw Convention. Once your bags were missing for more than twenty fours hours you were entitled to look for compensation. Compensation was awarded based on the weight of the bags as opposed to the value of the items in the bag. You could claim compensation for up to 23kg which was the limit that most airlines would carry. The level of compensation was approximately €22 per kg.

On 28th June 2004 the Warsaw Convention was replaced by the Montreal Convention. If you booked your flight on or after this date you are entitled to look for increased compensation. Under the Montreal Convention, air passengers can demand up to 1,000 Special Drawing Rights (EUR830 approx) for loss, destruction or delay of baggage. The value of an SDR is based on a basket of international currencies. The calculation is made daily by the International Monetary Fund and is available on www.imf.org. To read more about your rights when flying click here: http://www.eccdublin.ie/topics/air_travel.html#lost

ECC Dublin welcomes the Montreal Convention but is concerned that there is no minimum level of compensation that an airline must offer and it is unclear how to make a claim for compensation.

If you have experienced problems with lost or damaged luggage you can contact ECC Dublin for further advice and assistance.

With Aer Lingus you'd have to push to get any monetary compensation from them, particularly in the event your bag shows up.

However, if your bag is lost, they are not obliged to compensate you for the items in the bag and will offer a set amount. It is/was up to you to make sure you are adequately covered with travel insurance for such an event.

If you have your reference numbers, look here for updates:

Have a look under Services & Frequent Flyer on www.aerlingus.com for info on compensation

My parents along with my aunt and her husband arrived in Dublin yesterday morning from Philadelphia @ 11.30 and their 5 bags were missing also.
They were given tracking numbers and a website to use to look for the bags and when I tried to find the status of the bags on the web last night there was a message stating that the airline was not a subscriber to the service. That website is in the thread up further.
Anyway seems that the bags have been found and are being delivered this afternoon so I'd say that you're sure to get the bags back.

    Any update on this?

I'm sure we'll have one or two more of these incidents over the summer so would be great to know of any outcome.
