BCC decisions upheld

    The other complaints were brought against ads on TV3 by one man, Ray Di Mascio, who insisted they were basically fortune-telling chatlines.

    The voice-over in the Irish Psychics Live ad stated: “Love, happiness, discover your destiny.”

    Despite the company behind it, Realm Communications, claiming fortune telling did not apply to Irish Psychics Live because no-one claimed to have magic powers the BCC upheld the complaint.

    Tarot reading chatline, 7th Sense, faced a similar complaint that fortune telling must not be advertised on TV. But the company insisted it only provided tarot card services which it added was a skilled discipline not requiring psychic powers and that many people believed in it.

    Advertisements for products or services coming within the recognised character of, or specifically concerned with, the following will be prohibited:-
    (b) Fortune-tellers and the like;'

    The voice-over in the advertisement states: -

    'Love, happiness, discover your destiny.
    Call Irish Psychics Live on 1580 23 23 23, 1580 23 23 23'

    The Commission is of the opinion that this tells the viewer that by calling Irish Psychics Live one can find out what the future holds i.e. 'discover your destiny'. Under Appendix 2(b), such services are prohibited.
    The advertiser asserts that this section does not apply to their industry, that they are advertising a general entertainment service. There is no such differentiation made in the 1995 Codes, which defines an advertisement as '(i) any form of announcement, which is inserted in a programme service in consideration of payment or payments or other remuneration made to the broadcaster'. Therefore, whether the service being advertised is for 'entertainment' purposes, or otherwise, is not relevant to the assessment of this complaint.
    What is under consideration is the actual service that is being promoted by the advertisement. It is clear that this advertisement promotes, and encourages viewers to call, a service that comes 'within the recognised character of, or (is) specifically concerned with,….fortune-tellers and the like'. This is in contravention of Appendix 2 of the 'Codes of standards, practice and prohibitions in advertising, sponsorship and other forms of commercial promotion in broadcasting services.' This complaint has been upheld with regard to Section 24(2)(e)(advertising codes) of the Broadcasting Act 2001.

    I reckon we should start to email campaign to TV3 and Channel6 and the Radiostation with the Radio presenter in the ad to get these sorts of ads off air and shoot them dead if they put crazy frog back on the TV.

    The unbelievable truth.

    A scene from the fictional programme showed a man dressed in priest’s vestments pretending to handout Holy Communion to a group of men. But instead of saying Body of Christ, the character announced Body of Colin Farrell.

    RTÉ acknowledged they had pushed the boundaries but the BCC upheld the complaint and said: “The manner in which a sacrament was used for a laugh in this section of the programme went beyond acceptable standards.”

    Are you saying to boycott TV3 until the 7th sense ads are gone... But Id miss Trading Spouses :D ! Ahem, just to keep us safe here: we are not condoning the boycot of TV3. :D

    I know ITV practically own TV3 now but is anyone else getting really pissed off at the way the 2 of them show the same programmes at the same time. Here are some peak time programmes they share:

    Love island
    the from hell series
    Corrie
    Pokerface
    Hells Kitchen
    Emerdale
    And and Decs saturday nigh....
    Get me out of here
    Footballers wives

    and more. Its really annoying to flick through and see this. I don't have satellite or cable but still expect more from irish broadcaster.

    I am also aware that there are people here that daont get ITV

    Do RTÉ still have rights to The Bill? I recall them showing old episodes during the daytime.

    not im not saying boycott as it even I wouldn't bother with that, just an organised letter/email campaign...

    has this ad even with its 'its only entertainment qualifier' has been in breach for ages? years... is it only now that Ray makes a complaint that it gets actioned even though the commission knew it was in breach...
