    Hi,
i started a new job about 3 weeks ago. my previous employer wont bother getting me my p45 even though i have asked numerous times. i haven't been very friendly the last few times. i first asked them for it 3 weeks ago. i left on very good terms with them, i was told i could come back at any time. but they are just acting like pr**ks now. do they have a certain amount of time to give me my p45?

oh btw, i rang the tax office this morning and they are going to send them a letter stating that they must give it to me.

i was just wondering how long they have and what will happen if they dont give it to me.

As far as I know, nothing will happen to them. I had an ex-employer pulling the same ****, so I rang the tax office. I asked "what will happen if they don't give me a P45", and they said "they have to give it to you..." but when I pushed "yeah, but if they simply don't give me one, what will happen?". They couldn't give me an answer.

I'm nearly certain the tax office can issue you witn some kind of emergency P45 (called a P43 or P46b or something) with your tax credits if you really need one.

Anyway, you don't technically need to give your employer your P45 if you still have your payslips from your old job (you can calculate your pay and tax from them). I normally sort out my tax myself with the tax office and get them to send over my new tax credits...

Go to the tax office and say your P45 was lost in a tragic filing cabinet fire. Ask them to issue you with a new one.

    Will this work?

Well, it's easy to get your tax credits. You can just tell them you changed employer and will they send them out.

The difficulty comes when your new employer wants to work out how much you've earned already and how much tax you've paid. They calculate your future tax on that.

The tax office won't know how much you've earned or how much tax you've paid this year.

Is there someone within the company you can go directly to? Rather than calling your ex-boss and asking for it.

not really, none of the managers are any help and to make matters worse it has changed hands recently. the head manager bought it off her brother who owned it and it is now trading under a limited company of a different name. it is a franchise store though so the name above the door is the same.
