What are your opinions on Keane CJ? In my opinion he was (is) a man of marked intellectual ability; who adopted a position which led to a diminuition in the respect for the individual required by the state that had pertained before his influence was at it's height.

While one could not necessarily say that Keane CJ lacked an innate belief in the dignity of human beings, nevertheless the abandonemnt of the Christian principles around natural law might be said to have had that effect. Sometimes it seems as though for Keane the law existed (exists) in and of itself and could be examined only internally. He enjoyed the intellectual debate around legal issues (including the cases before him) so much that it may have seemed to those affected by his judgments that he had forgotten that the role of a judge is to find justice. *

There are positive interpretations of his time but it would be more interesting if someone who genuinely regarded him well put them forward.

    Be very careful here.

Well I am also looking for positiv interpretations. Do you think a debate on one of the most influential CJs we've had would necessarily be a defamation risk. If so remove the post.

It just might end up with someone saying something they could regret later. It should be ok once people keep their brains turned on.

I haven't read it, but Mary Townsend wrote an article on him, which sounds like it might inform the discussion:

Chief Justice Keane: The Modern Man And The Constitution

    (2004) 4 UCDLR 152

I think he's great by the way.

law existed (exists) in and of itself and could be examined only internally

    Oooh....like with an endoscope?

You're not writing a paper by any chance?

I had to rephrase it to make it acceptable to hullabaloo.

    My first version was:

Ronan Keane what a tosser eh? Am I right, you know I'm right.
