    Hi all,

    Just looking for a bit of advice. Does anyone know if an employer must advertise a position internally, even if they have already decied to give it to someone??? Had a guy promoted adhead of a load of us, and we dont wont to let the sh1thead management away with it. So any tips to give us the proverbeal extra leg to stand on would be super!!!

    Also feel free to bitch about your jobs here, I'll certainly be joining anyone who does!

    Same thing happened with my place. Supervisors job was filled without any notice or advertisment. Led to a fair bit of unrest among the natives.

    I think that the compulsory advertisment of promotional positions only applies to the civil/public service. (Open to correction on this).

    in private enterprise they can offer the job to who ever they like, as long as:

    a) there isn't a binding agreement with the unions
    b) there is an equality leglislation breech.

    If there is a genuine reason why the person shouldn't have gotten the job over someone else your only recourse is the labour court.

    And to be honest, just because 'the natives' don't like someone or their decision doesn't mean that it is the wrong decision.

    Nobody has a devine right to anything in the workplace.

    As said, in a private company, management have the right to promote and demote as they please, so long as it's within employment law.

    If they know who they want to give the job to, I think it's better to just appoint that person, rather than going through the pretence of interviewing all the applications who they know won't get the job.

    Happened all the time my last job.
    If its a private sector job then you don't have a leg to stand on.
    Only thing you can do is organise everyone to go on a "go slow" or arrange for everyone who feels a grievance to speak to their manager and ask why this happened, a full justification as to why this person was the best person for the job.

    Or you could just take a sh1te on your bosses desk....

    Is there a good reason for your grievance, or are you just annoyed that you were left out of the loop? If there's only one position, then they can only appoint one person. And if they know who they want, then why put the rest of you through the hassle of an interview process?

    It does of course feel rotten to be passed over like that, but as others have said at the end of the day your boss is the one who decides who is most suitable for promotion, thats why he/she is the boss.

    All you can do is try to prove to him/her next time that you are the best man for the job, maybe they didn't even consider you if they thought you weren't interested?
    I always make a point of letting my boss know what my ambitions and goals are and ask them what they feel I need to work on to become suitable for the role next time, this isn't sucking up imho its just trying to better myself and of course if such a role comes up again then they will course consider me next time.

    Its hard to be positive about such things oldschool, but if you do something silly now you'll only regret it later, at your next review or meeting with your boss let them know that you were disappointed to be passed over and that you'd like to know what you need to do to be there next time, a mature professional attitude goes a long way in most workplaces (if your boss is a reasonable person of course!)

    In some companies it's a case that there are x number of processes required for an internal promotion whereas it can be quite easy to just hire someone into a certain position. For example, they might only be allowed do internal promotions once a year, whereas they can hire for those positions all year round.

    Ever think that maybe he was promoted because he knows more about the job than you guys?

    Ive been in my current job since November, guy who started in January got promoted. Jealous? No. I pretty much know the system like the back of my hand now, and Ive been placed on supervisor duties dozens of times if the manpower wasnt available, Ive been told several times Im promotable material, but when they advertised it I decided i still needed another few months on the floor, learning every last bit of the system. He applied, he presumably thinks he knows enough for it, so good luck. Granted, Id be annoyed if the opening comes up again in September and someone who I genuinely believe knows less than I do gets promoted but for now Im grand

    Granted though, they always advertise the promotion internally, but tbh Id say in alot of cases the descision has already been made

    You do realise you likely end up helping to train the person on the system.

    Should have applied for the job and made it yours. Too late now.

    afaik, if its a vacancy to be filled it must be advertised internally but if its a progression promotion (ie. a person promoted to a more senior post within a department) then theres no such requirement.

    A big thanks to everyone for the advice. I assure ya'll its not sour grapes(well just bit, but thats human!). I just wanted to clarify exactly what the legal ramifications were. I have them by the short and curly's anyways over other stuff, but its nice to take on the establishment with diplomacy!!!:D :D:D:D:D:D

    You generally don't get a 2nd chance at these kinda promotions, as its likely they have formed an opinion of you of being unsuitable for the role thats doing to be difficult though not impossible to change.
