Recruitment Question?

    Friend recently took up a job through a Recruitment company.
    Friend has decided it doesn't suit. Employer has already paid the Recruitment company their percentage. But the Employeer has demanded it back cause he isn't there 6 months yet and is leaving! They have agreed but they also rang my friend and said that he will have to pay back that amount to them!
    Is this the norm or is it legal!
    Any info would be good

    That's nonsense and most definately not the norm.
    It's an argument between the agency and the employer - your friend ( the employee), has nothing to do with it.
    It's the employers own fault agreeing with the agency to pay the percentage so early on in the deal.
    Unless your mate signed a contract with the agency / company stipluating the above, it's hogwash.
    It might be advisable to name and shame this company to warn other potential employees.

    Yes I second the "it's nonsense".

    I am assuming it's the agency who want the money. He should tell them to **** off.

    It amazes me the standard of agencies in this country.

    It is ABSOLUTE nonsense.

    The contract is between the agency and the employer. The contract usually stipulates that if they leave before a certain period (eg. 3 months) all of the fee is refundable, and within another period (eg. 3-6 months) a fraction (eg. half) is refundable, and after another period (eg. 9 months) none is refundable.

    It is nothing to do with the employee.
    The problem is the agent who had the contract with the employer is now pished off as he lost his/her commission and is trying to shaft your friend.

    Who wanted your friend to pay? The agency or the employer?

    The norm is that should the employee leave within a certain time frame - anything up to 6 months normally (this is negotiated at contract stage) a percentage fee on a decreasing scale commensurate with time worked is refunded in the form of a credit note. The contract is between the agency and employer and not your friend. That's infuriating!!!!!!!:mad: :mad:

    I'm bursting to know which agency it is!!:confused:

    Your friend should report them to the Dept Trade, Enterprise & Employment. They are the people who issue licences to recruitment agencies.

    He has no contract with them and therefore needn't pay.

    I'd actually report them to the NRF. The sh1t would hit the fan. This kind of behaviour gives professional agencies a bad name.
