Help with ebay issue pls

    Another ebay problem.
    Basically, after the first phone getting ‘lost’, the seller sent me out another one. This is after 4 weeks of him messing me about and after me telling him to keep his phone and issue me a refund – however he still sent it out. While the first phone was lost I logged a complaint with Paypal ‘item not received’. After a while the second phone turned up. When the phone turned up it was not brand new as described, and it didn’t work. Logged a complaint (after I contacted seller many times to try and sort issue out), with paypal but u cant log two complaints on one item. Nothing more ebay or paypal can do!! So I complained to the credit card co and they eventually issued me a cash back. Its been about 50 days now and I just received a letter saying that ebay have declined the cashback or whatever, and basically they are going to take the money back out of my credit card. I really feel this is so bloody unjust and I am so annoyed. The phone cost me over 200 smackers and the way the seller emailed me telling me basically tough the phone doesn’t work, all this kind of malark, my blood is really boiling. Credit card co said they are going to try one more time but said its not looking good and if they are honest they don’t think it will help. Where can I go from here? What else can I do now? Any ideas? :mad: :mad: :mad:

    no just checked the ad and it doesnt say anything about warranty, but it never worked in the first place and was sold as 'brand new in packaging'. When i contacted the seller then to say it was broken he told me basically tough, take it up with Motorola.

    Its the sellers responsibility that the product arrives to you in working condition.
    This has nothing to do with the manufacturer.

    Don't really know what you can do to get satisfaction from paypal/ebay.

    So you went through with a PayPal dispute and an eBay Item Not Received or Not as Described dispute?

    Yup....
    Ive read horror stories on here before about Paypal, so that doesnt really suprise me, but i have to say ebay have been so unhelpful, automated emails all the time.
