whats the sentence ?

    Hi Guys
    of course just looking for an opinion and speaking hypoteticaly...
    Should a member of the public be caught stealing from a shop and duly
    admits, is arrested and sent to court whats the likelihood of a jail sentence?
    Considering if the joe public had never been arrested,never been in court
    first time offence is there a chance a judge would make an example and impose a jail sentence? In situations like this would said person need a solitor in court?
    any opinions greatly appreciated.

    It depends on what Mr Public stole. If it was only a small item, say clothing, it would probably not be a jail sentence, but a fine. However, if it were a laptop or something else expensive, then it could be jail. It depends on the circumstances of each case and the individual involved.

    Hypothetically speaking, this clean living, previously honest Joe Public could also try to approach the shop indirectly via the Garda dealing, and offer to repay the value of the item and, say, a contribution to their poor box. The shop owner may reconsider the charges and withdraw the allegation. Then again they may not....

    and if item cost under 200 notes...

    would jail start from the court date? would joe be taken away in shakels?:eek:
    again hypothecially speaking and just all opinons being bounched around;)
    and if joe public was holding his hand up and not denying the charge of course.

    If Joe is pleading guilty then the chances of jail are about 1 in a thousand however judges all have moods and personalities so its impossible to say it wont happen.

    Adult cautioning would have been used for a minor amount me thinks (DPP states 1000 euro or less but in practise the accepted price is a lot lower)

    As for lawyers, your call but most judges dont like people to represent themselves in court.

    I think it depends on a how quickly a warrant of detention can be drawn up. This could take a while. It may also be stayed in the event of an appeal. Garda manpower may come into it too. I am not too sure of the exact procedure, our resident Garda should be able to enlighten us.

    Normally bail would be granted in the event of an appeal.

    In the event of a sentence its straight into the cell and once the warrent is signed and deliveried of to the Joy or wherever.

    If an appeal is allowed its usually higher bail and requires a cash payment.
