Inheritance Rights

I inherited a sum of money from a family member two years ago. Probate was completed before Christmas. I notified the solicitors of a change of address almost a year ago and heard nothing back. I am not on good terms with the executor and I have heard through family members that he is claiming he does not know my location.

Is there a lenght of time after probate is granted in which the executor has to process payments to those named in the will?

Would it be of benefit to me to get a solicitor to deal with the executor in relation to this matter?

Are you looking for legal advice?

Nope - I realise the post is poorly phrased.

Basically I would like to know what my rights are in relation to this or where I can get info. What Google is throwing up is confusing me.

I would like to have a bit of info before I approach a solicitor.

Please just edit in something to say that you're not looking for legal advice into your original post. We have to be very clear on these things infortunately. Thanks.

I'm sure that once you do that, one of our number will be happy to give you an answer.

If I was you I would send a register letter to the executor and tell him you want your money and give him your address, tell him you will give him 2 weeks to get back to you, and if you hear nothing you will get a solicitor involved and you would be seeking interest of money owed and possibility solicitor bill aswell and dont forget to say Please

you could have a look at section 62 of the Succession Act 1965. Seems the executor has a year to divvy out monies.

62.—(1) The personal representatives of a deceased person shall distribute his estate as soon after his death as is reasonably practicable having regard to the nature of the estate, the manner in which it is required to be distributed and all other relevant circumstances, but proceedings against the personal representatives in respect of their failure to distribute shall not, without leave of the court, be brought before the expiration of one year from the date of the death of the deceased.

    (2) Nothing in this section shall prejudice or affect the rights of creditors of a deceased person to bring proceedings against his personal representatives before the expiration of one year from his death.
