    Hey

    Just a quick query

    What recourse, if any, is there in the following scenario?

    Pay a 300 euro deposit on an item, get a receipt, go back into the shop 2 days later and the shop has sold the item. Shop, and one individual there in particular, is seemingly notorious for such behaviour

    Breach of contract under the Sale of Goods Act 1893. The remedy available is to sue for damages and compensation for the breach. I think this would be covered by a number of provisions, but most importantly, S. 12 which is the implied condition as to title. Thus, due to a breach of a condition (as opposed to a mere warranty), the buyer is entitled to damages and compensation.
