    Folks I was in a crash a while ago and I want peoples opinion on it!!

    Scenario!!

    I was stopped at a set of lights waiting to turn right! Suddenly I was rear ended and pushed into the car infront of me, when I got out of my car the car behind just tore off!! Now It took six months to get into contact with the owner of the car that rear ended me! After a week or so he relluctantly agreed to pay the cos of damage to my car and I agreed not to go through his insurance!! Now upon payment he told me that a solicitor advised him not to pay because it took so long to get into touch with him!!

    The reason it took so long was because he failed to answer summonses to the garda I reported it to!!

    What I would like to know is:

    1. Would a solicitor advise that or what would they advise them to do??
    2. Would anything fall back on me because I didn't go through insurance??

    so to be clear ... he left the accident without giving his details , and his defence is he doesn't have to pay becuase it took too long for the cops to track him down ?

    He is talking crap, the statute of limitations for negligence is 3 years (I think it might have recently been brought down to 2 or 1, not sure if those plans went through), in any case it's longer then 6 months.

    Well in a way I am looking for general advice!! I kept it out of courts and away from the insurance with an arrangment that I got the cost of the repairs!! (Sorry I should have added this above) Now apparently his mother is a solicitor or knows one or something like this and they drafted a legal document to say that I received the sum of money etc... I signed it in agreement but wondering is there any way now for him to counter claim or anything like that??

    just get his insurance involved. prolly will refuse to cover him since he sped away but I would still contact them.

    Well i took payment off him and signed the document because at the end of the day I didn't want it dragging on!! Now it was filed as a hit and run with the gardai so they contacted his insurance company about it!!
