Maternity - Returning Part Time

    If you return to work part time after maternity, having been a full time employee prior to maternity, are you entitled to your full compliment of holidays up to the date of return that would have been accrued while on maternity leave, or are you only entitled to a fraction of them as you return as a part time employee?

    Instinct tells me that the employee would be entitled to all leave up to the date of her return (at full time rate) and then at the rate of 8% of time worked from then on.

    "Annual leave is not affected by other leave provided for by law (this includes maternity leave, adoptive leave, parental leave, force majeure leave and the first 13 weeks of carer's leave). Time spent on these types of leave is treated as though you have been in employment, and this time can be used to accumulate annual leave entitlement. However you do not accrue annual leave while on sick leave, occupational injury, temporary lay-off, or a career break."

    As Litcagral says, your previous leave entitlement is not affected, and you will only get your leave on a pro-rata basis from the day you start as a part-time employee.
