Right, I am working for a company at the moment.. We were told 3 weeks ago that for everyday sale we make we get 10% of that sale in commission: Usually either 3-5 Euro..During the Month i made 175 Sales I should get approx 600 Euro... I got 130.. Everyone got around the same.... Anyway Work turned around now and say now they are only paying 10% of what the company receives... Can they do this? They are refusing to pay the commission that i earned.?

Did you get it in writing or was it a verbal announcement in a meeting? I don't know if you can hold them to "their word" if it was verbal. Could just be a bad/sneaky manager, possibly.

    remember the golden rule,

"He who has the gold, makes the rules"

It looks like you got screwed, i take it that you are not part of a union, if yes - contact them, if not you should contact them, i will cost u nothing for advice

I take it that u didnt get a contract!

No one in the company has a Contract.... There is no union in the company.I no what ya mean about the rule... But surely they cant change it without notice on the day we receive our commission?

No union and no contracts will make it very difficult to make them hold to their word imho. They can say you "misheard" in the meeting or that it was a "genuine mistake". It could have been a mistake but I've seen too much dodgy stuff with commissions to believe that tbh.

Fair enough but what if people from work back me up on this... If they refused to pay and took it to small claims would i stand any chance.. 500Euro isent something i am willing to forget to lightly

I don't know the legalities mate, sorry. Am just talking from past experience. You may or may not be entitled to it, I really could not tell you. If it was written it would be very straightforward. It being verbal, I don't know.

AFAIK Dan the Small Claims Court deals with goods and service. It does not involve itself with workplace issues.

PS Was there an upper limit mentioned in relation to the comission, e.g. 10% up to a maximum of 'x' amount.

No nothing at all mentioned about an upper limit...
