Breaks and entitlments.

    Heya all,

    I just started a new job. I come in at 7.45 every morning and finish around4. I was given out to yesterday for going home at 4 and i questioned why i was being given out to.

    We only get 30 min break every day and my contract says that i need to be doing a 40 hour week.

    So if i was to start at 8 and finish at 5 everyday what are break entitlments? I think 30 min break is a little low of a break.

    Rests and intervals at work. 12.—(1) An employer shall not require an employee to work for a period of more than 4 hours and 30 minutes without allowing him or her a break of at least 15 minutes.

    (2) An employer shall not require an employee to work for a period of more than 6 hours without allowing him or her a break of at least 30 minutes; such a break may include the break referred to in subsection (1).

    (3) The Minister may by regulations provide, as respects a specified class or classes of employee, that the minimum duration of the break to be allowed to such an employee under subsection (2) shall be more than 30 minutes (but not more than 1 hour).

    (4) A break allowed to an employee at the end of the working day shall not be regarded as satisfying the requirement contained in subsection (1) or (2).

    Should be in your contract. You do have a contract?

    The contract states 30 min, but for 8.30 hours work and a miserable 30 min break is pathetic. 30 min break all day what a joke.

    Did you not read the contract before you started? I'm surprised there isn't a 15 brake in the morning but some places are just mean about it. People will go for a smoke or bathroom for a break anyway. Look for something better IMO.

    Yeah i am thinking of it, cause the crappy break entitlments is a joke. Thanks for advice mate :)
