Where do i stand.....?

    Been working for a Company for 3 Months now... No one in the company has any contract signed... Anyhow before i started i requested certains dates off ( Heineken Cup 1/4 and Semi) been too all the matchs.. I put in a holiday request form on the monday after the match only to see about 10 other people requests aswell... None of which have tickets/ flights etc.. I do...I said it to her.. Look i have my tickets etc she said its first come first serve... Now i am going to this regardless prefer to keep my job but it needs be will leave. Question is if i get a doctors note ring in the 4 days i requested off can they do anything about it? The Worry is i dont have a contract?

    Does this company really need you? If not I'd be careful. They can easily sack you and the Unfair Dismissals Act won't cover you as you have less than 365 days service. In a lot of organisations, requests for time off is given based on seniority (unless in exceptional circumstances). Going to a sporting event would not be deemed exceptional-unless of course you are playing!

    Honestly the company need me alot more than i need them... The thing is its a job till End where i am moving to the Uk but the company at present do need me. Also was left almost 500 Euro short of my commission Yesterday so not really happy about that either

    You could chance it Dan but if you submit a sick certificate they are legally entitled to reject it and request that you see a Medic of their choice.

    Re Contract: They are not obliged to provide you with a written contract but they are obliged to supply you with the terms of your employment within two months, i.e. wages, holidays, sick leave etc.

    If this company needs you, go to the game. You can always offer to work the time back if it comes to the crunch. I totally disagree with the "first come first serve" approach. It's totally unfair as people can book time off that they don't really need just to keep their options open. While many would argue than seniority is unfair at least there is a system and one is becoming more senior all the time. Enjoy the match. :)

    Ya all the holidays requests were filled in on the Sunday after Munster won the Match.... All the Women are the ones requesting it off... Obviously cos there bf /husbands rang them and requested them to get it off.. While on that Sunday was i was at the match and wasnt working till the monday so couldnt request the time off till then.

    That is a stupid attitude to have. You should have asked for the time off BEFORE buying flights and tickets. It was very shortsighted of you to just assume you could have the time off, you don't seem to have learned from your mistake!

    just because they don't have tickets and you do .. does not 'entitle' you to preference.

    unfortunatly if it is 1st come 1st serve you are out of look.

    taking sicks days is irresponsible and will hold you in no favour for the future and you can can be sure that you won't ever get preference in the future.
