Fired! Can I expect holiday pay

    Hi
    I was recently fired for acting the muppet. Thing is the company in question was undergoing a take over and and had asked that staff not take holidays from January till May. This meant that I had 25 days leave built up when I got fired. Can I expect to get my holiday pay? Bearing in mind that there is no question as to whether or not they had a valid reason to terminate my contract or not.

    Any coments are greatly appreciated as I have to call my old boss today about something un-related and thought i may aswell kill two birds with one stone.

    If you built up those days then yes, they have to pay you for them.

    I don't understand how you could have built up 25 days leave in the space of four months...most companies ask you to use up your leave days before the end of the year, and on average give you 1.5-2 days off per month worked so...how did you build up 25 days?

    Apologies I had 5 days from last year that i carried over and then they gave me the full allocation of holidays for the next year, ie i didn't seem to have to build these up. To be honest it seemed a bit extreme to expect the full 25 days so if i can get a fortnight i will be doing well it would seem.

    Most companies work on a pro rata basis. So you are allowed X amount of hours holiday per day worked. Your 25 day is prob for the whole year. You wont get all this, just what you have worked up since the start of your company year to the termination of work.[+ any hols carried over]

    Carry over can depend on company policy. Unless it's company policy to allow you to carry over, you're not entitled to be paid for holidays which weren't taken last year.

    As Clseeper says, your holidays for this year will be worked out on pro-rata basis - you won't get 20 days' pay, you'll get (20/52) * number of weeks worked this year.
