Fire hydrant sign in my front garden-help!

    Hi, I am new here and to be honest I am at my wits end. I have been searching the net for the last 3 hours looking for a law or a right to protect me a home owner.

    I have been a home-owner for the last year and a half in the East of the Country. I came home from work to day and nearly died to see a huge headstone from a grave type pillar sticking out of the grass in my front garden. It had a big yellow H on it , and to be honest it is disgusting looking. It is taking the whole look of the front of my house and I am so upset about it. :D
    Our row is a terraced row, and we are attached only on one side. The gardens are wuite small and we dont have a fence/hedge at the boundary. It is right outside my front window. I am so angry.:cool:

    If anyone knows anything about the laws or if there is anything I can do, please please let me know.:rolleyes:

    unfortunatly this thread will prob get closed. Ur best bet is to edit your post and make it hypothetical. Then it will attract more attention and not of the attract the wrath of the powers that be. IE its not you, and you are not looking for advice, just wondering if anyone has any thoughts on the issue

    Well, I'm not going to even bother closing, or editing this thread. I am going to tell you this, however:

    What is it exactly you think that hydrant sign is for? It's not an advertisement, if that's what you're thinking. It's to let the fire brigade know where they can get water, with which they can fight fire. Now, I don't know what sort of priorities you have, but I would regard the safety of me, my family, my property and that of those around me above the aesthetics of front lawn.

    By the way, I hate smilies as well.

    But do the Government/council have a right to build on your land without even informing you? That's seems quite absurd. Maybe the person here can claim compensation for loss of enjoyment of property?

    Why would the poster think that the hydrant is an advertisement? (Perhaps for dogs looking to relieve themselves...)

    I would be most unhappy if I were to return home one day and find that my property has been tampered with, without permission or prior notification. However my limited legal knowledge has no idea what possible laws this could be breaking (possibly in the property rights section - Art. 40.3/43 of the Constitution and Art. 6 in the European Convention of Human Rights).

    I am very grateful to the last poster for putting my mind at ease and making me feel like I am not the only one who would feel bad should it happen.
    The point is, it has happened.

    I am quite aware that a fire hydrant sign is not an advertisement, but I guess it may be beyond your legal knowledge to realise that there are certain height requirements for a fire hydrant.

    By the way here is a smilie just for you:mad:

    I am not just annoyed about the fire hydrant, I am upset about the fact that a builder walked into my front garden and dug it up without my permission.:confused:

    I have since been on to my solicitor and the NSA, and I am pleased with my results.

    As far as I know [and I maybe wrong] is that the enjoyment of property in connection with terraced houses under a council extends only to the rear garden. In the interests of public safety a council may place a fire hydrant usually marked H, on a yellow background, where-ever feasible. The very fact that you metioned that you are attached only on one side implies that you are the end house. Usually the ends of terraces support the main water supply and sewage for that block, and would be liable for things like these. Its like a compulsory purchase order, once its for the common good.

    No they don't what the OP has to do (I think -and this is not legal advice) is apply for a Section 666 order under the
    European Agreement for the Protection of Personal Gadens (Herbaceous and Floral-Non Agricultural) 1975.

    The letter should be in French and must refer to Section 666 of the statute.
    Please enclose A bank draft for EURO 1000 payable to section head Bertand Earer (Just mark it B Earear).

    PM and I'll tell you where to send the draft. (Surprisingly it is in Rathgar but obviously it is confidential so PM).

    So what are the conditions before they can unilaterally change parts of your property? Is it:

    1. Front garden of terraced house only
    2. Interest of public safety
    3. For common good?

    But surely even if these are the conditions and they have been met the council should inform the residents that there were be building work going on on their premises?

    *edit* MM lol your post wouldn't be trying to falsely solicit funds would you? Isn't that a criminal offence? (Not trying to defame you or anything ;) )

    I think we have been very helpful as helpful as we want to be anyway. Still haven't got that message from you.

    I can only assume that there is no house, no hydrant and to judge by your IP address you aren't even in Ireland.

    So you're upset because what people said wasn't to your liking? IANAL (or even a law student) but it would seem obvious to me that public safety takes priority here. I would have thought they'd notify you, though...

    Where is the actual hydrant?

    Is the "garden" actually part of the house or part of the public road?

    Is this not a basic act of trespass ?

    Will the local authority have implied consent if OP does not kick up a fuss and challenge the basis on which they purport to have the authority to do what they did ?

    Is there any chance OP that the hydrant has been there all along, unknown to you, and consented to by the previous owner(s) of your property ? It might always have been there but buried under soil or grass.

    Why on earth ban someone for enquiring about HIS rights over HIS private property. Of course he is being banned for vulgar abuse, then that is a different matter!

    It seems he is perfectly within his rights just to remove it (if it is his property). "Public safety" doesnt take precedence over private property in Ireland except where there are clear exceptions.

    The closest analogy I can think of is the ESB, and they are obliged to seek permission from the landowner before putting up a transmission pole, and pay compensation thereafter.
