    Long story short.

    Knock for knock car accident with no witnesses and no injuries...insurance companies paying out to both parties for repair to vehicles etc

    Then out of the blue the other party is slapping me with a civil bill to recover vehicle repair costs which will be paid out to the other party by insurance company anyway....what the frig is that all about:mad: , and can the other party do that...? Why the hell do we all bother paying out for insurance if greedy compo spongers are going to trot out civil bills for no reason :mad:

    Someone console me...I'm seriously miffed:mad: you.

    First off, who was in the wrong? If you were then this person is completely within their rights to sue you for damages caused to their vehicle and their health.

    As you say insurance is paying out but why should they suffer increased insurance payments if the crash was your fault? I would imagine that they are actually going to sue your insurance company and not you directly. This means that their driving record is intact and they dont suffer financially for your actions.

    what he said. if this 'affair' has been even investigated by the gardai, there would be statements which one would be entitled to have access to insofar as they relate to the case and the gardai could certainly be called as ones witnesses to bolster ones 'defence' of such an action. Again, paying somebody for professional advice is something you're gonna have to do *anyway*, irrespective of the advice you get here!

    I can only take a guess at what is happening here and of course what I say is not legal advice etc etc so I take no responsibility for it.

    But afaik thats what happens in most car accidents-one of the parties will involve their solicitor and you contact your insurer who will tell you to foward all the solicitors letters etc to them and they will deal with it.

    Your insurance company will employ a solicitor to reply to the other party(often they employ your own)

    You havent said where the blame lies? but your insurance co without a doubt will attempt to establish this as best they can before they pay out.

    To conclude-dont worry about the civil bills -just contact your insurer and let them deal with them.These things often dont end up in court by the way-they are settled before hand.The other party is just either chancing his/her arm if they are in the wrong or just covering all bases.
