VISA to enter Ireland

    Hello !

I found this forum by surfing the net and I need an advise, if you can help.
Next week my girlfriend will arrive in Ireland with a Tourist VISA for 1 month, she`s from South America.
I would have preferred her to stay a bit longer but the Immigration Office approved the VISA only for 1 month and it`s not possible to renew it.
If she decide to stay here longer then 1 month (it took us 5 months to get all necessary docs to make her travel), when is time for her to leave the country, what it can happen when the officer at the airport notice that she didn`t respect the VISA expiry date ?

Maybe you had a similar situation or you work for the immigration office !!! ;):)

Thanks if anyone can give me an idea.

Not sure about Ireland but in the US if you outstay your visa you will have a very hard time getting another one. I would imagine its similar here.

Might get a better response in the 'Legal Discussions' forum, but you might wanna make the thread more 'hypothetical', cos it's not a legal advice forum unfortunately ;)

Well I wouldn't advise overstaying your visa if you want to come back to the country ever again!

AFAIK you are probable not from Brazil as they automatically quality(reciprocal agreement I think) for 3 month VISAS(Had a Brazilian friend in the past).

No EU passport holders and priveleged others(US/Canada/Australia) have little trouble entering Ireland...but as you are clearly outside of those areas then i honestly dont think you would like the consequences of staying here beyond your VISA date.

I have another friend who stayed 18months in Brazil on a 3month visa...was jailed for 20 days. and then deported to France(quickest EU plane flight).
On returning to Ireland he found out he would be fined a paltry ~€500 on returning to Brazil.

Im pretty sure anyone from South America wouldnt be jailed....but would probable get a fine or not allowed to enter Ireland for a period of time.

I always thought visitors were allowed stay up to 90 days and if they wanted to stay longer they had to get a stamp on their passport from the Garda Immigration Bureau, or your local garda station's immigration officer. Maybe its different for other countries

Overstay EU visa = Deported and Banned from ever getting a EU visa again ...

If she plans on overstaying it, make sure she brings a camera.

    Thanks for your replies.

It`s not easy decision to make.
I presume I`ll have to get married to give her the resident VISA... :)

Could you not enroll her in one of the cheap language schools in dublin city centre?
Fees start at about E1800 for the year and if you enroll in one that is approved as a educational course (ie Cambridge English exam) she can work 20 hours a week and work full time on course holidays.
My girlfriend just extended her visa for another year in January. You need to keep your attendance pretty high as you need a letter from the school to extend the visa.

You might want to look at Ireland's laws on divorce before doing that...

Of course it's an easy descision to make! She won't be able to visit you again if she overstays her visa and surely you don't want that?! Are you an irish citizen yourself?

She will be deported to Lagos on a special charter flight in 3 to 4 years.

Doesn't matter if you get married, they'll deport her first then fly her back to Ireland, then start a judicial review which will eventually end in another tribunal.
Ten years later when thats finished, they'll bury the findings with a court order and deport everybody with red hair to Scotland.

On a more serious note, if she can get a job she can apply for a work permit. Technically the company should do that for her, but she can get the paperwork together and get the boss to sign off on it.

If you outstay a Visa, after you go back to your own country. They will most likely not let you back into the country again.

I am not an Irish citizen.
I know if she overstays, once out of the country she`ll not be allowed to enter again for the next years, but it`s a risk I am willing to take. (i can always relocate somewhere else)
I`ve been dealing with her immigration paperwork for the past 5 /6 months + all the money spent to do that. It`s a shame to have her here only for 1 month after all we went through. Once she`s gone I`ll have to start all over again...
I believe a good idea will be to try to employ her (or as student) so to get a VISA extension....

If she is lucky she will be deported only. Otherwise jail time, fine, deported and marked as never allowed into the country again. If in the future you were planning to marry her it could possibly stop that from happening.

There's also a good chance the immigration officers at the airport will keep her detained for a few hours at least - so she'll almost certainly miss her flight and have to pay for another one.

Did you know that visa for Brazil can be gotten again at the border? A simple bus trip out of the country and back in every 3 months would have solved his problems.
