What do u think about my ebay buy...

ok, i bought a phone on ebay, paid for it etc etc, everything grand. was told it would be sent via courier and i would have it in 2-4 days. three weeks later, numerous emails to seller (via ebay and personal mail) and i was getting no response, oh and had a phone number too and the phone kept getting answered and then hung up straight away. so i filed a case with paypal, which is still pending. after i filled this the seller of course contacted me, saying the phone got lost with courier but wouldnt/couldnt prodive me with tracking number. said he would send out another. i mailed a few times to say i didnt want a new phone, i had bought one - which i really did. even after saying i wanted a full refund, he sent out the phone which i received but didnt/dont want. he wont give me a return address to send this to for a refund. this guy has really given me the run around on this transaction, he has told me such lies - told me he couldnt respond to my emails because his pc was broken for a week, but that was after the paypal complaint and he did respond. it was obviously a lie that the first phone was lost - he wouldnt provide me with a tracking number, told me he is no longer trading on ebay cause he got scammed and his paypal account got emptied so thats why he wont take the phone off me to resell. this guy was a powerseller and had mostly v good feedback. anyway, what im wondering is, do u think i am entitled to get a refund? ive only ever bought a few things off ebay so not an expert on the whole thing, and this has really turned me off :mad:

entitled to a refund and getting one are 2 differant things....where was the seller based??

Im a similiar situation at the moment. I bought a satellite receiver off a
german powerseller a few weeks ago and it still hasnt arrived. I payed him through paypal but I had to go through some german site called afterbuy.de and then onto paypal to pay for it. Anyways I emailed him numerous times after I payed for it about tracking details etc and he never replied to me. So 2 weeks later I emailed him and said if he doesnt repsond within 24 hrs i will report him to paypal/ebay. Then the next day i noticed that another buyer had given him bad feedback for not receiving their item even though they payed for it in december! So i filed a claim with paypal and gave him negative feedback. Unsuprisingly, he finally decided to reply to me and said

" Hello,

was very Ill, i found your reciever. >Do you want it all ready or you
want your money back. Please let me know!"

He was so ill that he had time to add new items for sale during the 2 weeks he didnt reply to me! So i said I want a refund to my paypal account immediately. A few days later I got an email saying this:

" Dear XXXXX:

We are contacting you about the following item: XXXX

The seller, XXXX tells us you have mutually agreed not to complete the transaction (e.g. because you returned or are returning the item for a refund or because there was a misunderstanding) and has requested a credit for their eBay fees.

Please respond by 17-Feb-2006 so eBay knows whether you have agreed.


Message from seller:
P,lease take back, I send your money back. "


So I emailed him back and said im not withdrawing any feedback until he refunds me as he could just ignore my emails again like before. A few days have passed and he still hasnt refunded me.

This is the second powerseller with good feedback that I have had problems with now since xmas. They think they cant treat you like **** just because of their feedback but this seller aint gonna sell much with the feedback i gave him!

Sry for delay in reply, no internet access at home - getting installed this week - seller is based in the UK. File is still pending with paypal so im waiting for them to get back to me.
