Chicago-Summer? Visa Restrictions.

My sister and friends are planning a trip to Chicago for the summer. They aren’t planning on getting a visa and were hoping to go on the visa-waiver programme for a 90 day long holiday ;) . Three of the group were in the US before on the J1 and have there passports stamped etc. I’m just looking for some info. on the restrictions involved. A person has told me they will be restricted from visiting due to the fact they were there on the J1 before. They all complied and abided by rules while they were there before. The problem is that would Immigration spot the J1 and think they'd be there for the summer working, which they plan to do

Has anyone ever done this before and how did it work out?

The problem is they can't get the J1 as they are in their last year in college. Is there other similar visa's that would suit so they'd be doing everything above board?

    Any help is appreciated.

I think what most people who are going to work illegally in the states do is buy a ticket with a return date in two weeks, they tell immigration that it is a two week vacation they are going on and then they change the date of their ticket when they get over there.

When I went over last summer I told them I was going over for 2 weeks, they ask some questions like where you work in Ireland , where will you stay in America , why you want to go there. There was a couple of lads going with me but we split the group into 2. We went at end of May so not as many people there we also flew from Shannon.

Planning to go to Chicago my self this year, I hear there is $1 beers going to be deadly. You know much about chicagi

Don't know much about it only it's called the Windy City! It has beaches on Lake Michigan I believe and has a lot of High-Risers. Anyone know if there is a legitimate way for my sister to do the J1 Experience without the J1. Is there other visas to be got and if so how?

The easiest (and only way) for your sister to get the J1 experience in a legitimate way is to get a J1 visa... she's not automatically excluded if she's in a final year - she just has to apply for a post-grad, once she has proof that she'd applied and is comming back to study next september, then she'll have no problem getting a visa. In fact, USIT actually advertise this workaround/loophole as a way for people in final year to get a J1 without actually having to go back to college for another year.

Your sister won't be obliged to accept the postgrad offer, she just has to apply for it and have proof of her application. Call USIT, they should be able to give more detailed info.
