I won an auction and the seller is refusing to honour it. Does anyone know where I stand legally?

    On what grounds?

    Report the seller to ebay

They said that they were advertising goods and were not prepared to part with them for the amount that I had won the auction for

AFAIK all you can do is leave negative feedback. Unless money changes hands everything is just good faith.

Even if the law was on your side .. practically it's not!

    my two cents :(

    Hey ZOD,

Are you sure about this? Any experience with this type of thing?

I've bought quite a few things off ebay and never experienced that..

I think that there is very little ebay can do if the seller decides to not honour his commitment unless he's a power seller ..

I think it's grounds for getting them dismissed from Ebay, however.

If they didn't set an auction with a reserve, etc, then in their ignorance they have mistreated you.

Read the help pages on ebay for details.

Leave negative feedback and report him to ebay. Ebay will not really do anything unless he has a record of doing such things. He could just tell ebay that the item broke as he was packing it.

Expect to get a negative in return from the seller though
