Leaving negative feedback

    If you leave negative feedback on a legit gripe, is the other party free to do the same for you even if you've done nothing wrong?

    I recently bought a "gone with the wind" dvd for my mother. It arrived and was 4:3 despite being advertised as widescreen. It also appeared to be a fraudulent copy. It was just a bit shoddy. Though it is supposedly made by a chinese supplier, so I /could/ be wrong on that. It had no encryption, which is a bad sign in my experience. Also, it game on two single layer discs rather than one dual layer one.

    Anyway, I've got a small but good feedback record (13 positives) and I don't want some dodgy character ruining it.

    Note that the seller is a power seller with over 1000 transactions and a decent (though not spotless) history.

    See my last comment in other thread (P&P rip-off and all that ;) )

    My rule of thumb (for the last 6 years - 180 feedback, 207 transactions, 1 negative) is:

    if

    (i) everything else has been tried (emails, messages, etc.) and

    (ii) it's too big a deal, e.g. paid £- or €-XXX for a lappie and it never arrived (never happened to me - and how 'big' the deal is, is all relative and personal)

    - then yeah, neg' away

    otherwise, don't bother - more to lose from negs on your feedback (say in terms of opportunities scuppered because buyer or seller not trusting you) than a few €s on a dodgy DVD (which you can watch, after all ;) - use Azureus next time :D ).

    did you message the seller?
    tell them that the dvd is fraudulent(it is, btw) and that its not as advertised.
    tell them that you will now leave negative feedback for them. Unless they refunded you the money.
    Make sure you use the internal ebay messaging system, so that ebay can have a look at it if you have any problems.

    There's always eBay's internal copyright/DRM thingy (name?) - if that seller has a big rep, they may not want to have eBay look into/freeze their auctions.

    Then again, maybe that stuff is legit in HK or wherever they are (but they'd still be breaching EU and/or at the very least IE law when exporting to you)...

    [cynical] but then again maybe eBay raking fees off this seller's apparently very numerous auctions may turn a blind eye[/cynical]

    Hmmmm. I did message the seller and did report them to ebay, but in the message I sent to the seller I only mentioned the 4:3 discrepancy and said "where do we go from here?" kinda thing. I suppose if I had to start from scratch with 0 feedback (I think that's better than 13:1) it wouldn't be the end of the world tbh.

    I'll see what the seller says. If I get my money back, I wont leave negative feedback, otherwise I will. I hate getting screwed like that. I paid decent money for it. Wouldn't have been much more expensive to buy it off amazon like.

    As far as I know, Gone with the Wind was filmed in 1.33:1 ratio which is 4:3. The DVD released was in this 4:3 ratio.

    Not withstanding the above, it definitely sounds like you got a pirate copy. How much did you pay for it?

    Nice 4 disc set available from DVD Import in Canada for about €26 delivered

    Hmmmm. Seems you may be right. It may only be available in 4:3. Still...his ad did state widescreen.

    I paid about a tenner including delivery for it.
