When you a pay a deposit for renting a flat(but haven't signed a lease yet), is the deposit refundable if you change your mind? I stupidly paid a deposit for a place only yesterday and now I am having serious doubts about wanting to live there. Thanks for any replies...

I don't think they are legally obliged to return a deposit. Shops usually do as they want to have a good public image. However, the flat owner doesn't need to maintain this image as the demand for housing out-weighs reputation.

Find another tennant to replace you, and collect a deposit off them. Stick an add in the paper/online

Why don't you pose the question in the Accomodation forum? http://www.boards.ie/vbulletin/forumdisplay.php?f=38

I was fairly sure if she hadn't signed the lease or moved in she could get it back?

My frend hadnt signed anything either and she gave the landlord half the deposit to hold the place , that evening realised this wasnt the house for her , rang up the landlord and got a right earful about timewasting etc etc , Frankly I dont think she was tough enough about getting the money back but the landlord was quite adamant she wasnt getting a penny back and thats what happened.

I reckon it depends on the landlord/lady if there sound Im sure ya`ll get it back but if they turn around and act the prick etc etc it could go either way.

Call these guys in the morning.

I'd say you're entitled to your deposit back.

Unless you have a written agreement which states that the deposit was refundable, they will be under no obligation to return it. If you can spin a good line and appeal to the better nature, or get someone else to take over the tenancy for you, you just might get it back.

But in general, deposits are non-refundable unless there is something specific which states otherwise. That's really the whole point of a deposit, isn't it?

These guys might be able to provide expert help.

Of course not having signed anything also means the OP has no proof he/she gave a deposit.

Who gives money away without getting a receipt?
