The Incredibles is a playful, respectful pastiche of superhero stories. And when we get down to it, there are really only a limited number of super-powers that one can reasonably use without getting absolutely ridiculous (I mean.. a guy can do spider-stuff after being bitten by a radioactive spider? Noone will buy into THAT much ridiculousness). And I think these are covered by the main characters in the Incredibles. If one even wants to go down the road of "satire", we could whip out the "fair use" card.

In the case of City of Heroes (the game that Marvel are in such a tizzy about), we have a bunch of people who are effectively able to BE Superman, or BE the Hulk, or BE... and so on. Although there is a lot of respect for the superhero genre in City of Heroes (their tribute to Christopher Reeve was actually quite moving), there isn't enough of a difference there for Marvel to be able to sleep comfortably.

Then we also have the fact that Marvel is supposedly creating its own massively-multiplayer game based on its superheroes, and City of Heroes is clearly muscling in on its territory. Whereas Marvel haven't got balls enough to create something as wildly entertaining as the Incredibles.

I suppose The Incredibles could argue that it's a satire on superheroes, as far as I know under US law (and probably international laws) it is ok to use someones image or characteristics without their consent if its in an obviously satirical context, spitting image being the prime example of such. I'm sure that if Marvel have made any legal inquiries into the movie this is the responce they'd get.

Look everyone knows that the Flash is just a copy of BIlly Whizz from the Dandy.

    Jeez.

I can't believe they got away with *that* one.
