Holiday Pay

    This is my first job.
    I've worked for the summer.It is coming to the end of my contract.

    I have 6 days of holidays coming.

    I was told,to take them off.

    If i stayed and worked those 6 days,and never took holidays...Would i get the 6 days pay,as well as the holiday pay coming?

    You should, your entitled to them by law alright.

    Yes your entitled to either pay or the days days off. But I think the company is within its rights to ask you to take the days off.

    Annual Leave and leaving employment
    It is illegal under the Organisation of Working Time Act, 1997 for an employer to pay an allowance in lieu of the minimum statutory holiday entitlement of an employee unless the employment relationship is terminated. In general, your annual leave is calculated on the basis of hours worked.

    Statutory holiday entitlement is something like 1.25 days per month isn't it?

    1.25 Days per month if a salaried member of staff. If working on an hourly rate you get 8% of the hours you have worked.

    Legally you have yo take your holidays as the Oasis link states. It is not permitted to take pay in lieu of your statutory holiday entitlement

    Also, you usually won't get any holiday pay you're due when you leave until after you receive your P45. Which, with some poxy employers, can take months.

    Employers are not allowed to pay their staff as opposed to giving them holidays. i.e you cannot NOT take holidays and just receive the holiday pay instead as you are still legally entitled to 8% of your working hours as holidays. Howver in this instance as you are leaving the company, the company are obliged to pay you any holiday entitlements that you have worked up.
