Should the Morris Tribunal pay the McBrearty's legal costs?

    FINE Gael MEP Jim Higgins said last night the Morris Tribunal should make special provision now for the legal costs of the McBrearty family.

    He said the next phase of the tribunal's work in relation to false Garda allegations against the McBrearty family, arising from the roadside death of Richie Barron, would undoubtedly be frustrated unless the tribunal made special provision for the payment of fees to the McBrearty legal team.

    "The tribunal must immediately make this provision available. The Morris Tribunal would never have come into existence had it not been for the work carried out by the McBrearty legal team in order to prove their clients' innocence," said Mr Higgins. "One has to see the stand being taken by the McBreartys in refusing to appear before the tribunal without legal representation in this context. How the tribunal cannot see that it will be impossible to arrive at any definitive conclusions in relation to the mistreatment of the McBreartys without their presence is beyond comprehension," he added"

    Spot on. This harrassment by the Gardai in Donegal has cost them over 200,000 euro, according to media-reports. An investigation into Garda corruption in Donegal that does not involve evidence from the McBrearty's would be like trying to drive a car without petrol. What do you think though? Up to now the Government has refused to pay the McBrearty's legal costs.

    I think the state should, yes, guarantee them at least part of their costs, but not carte blanche.

    Tribunals don't usually guarantee people their costs so as to encourage people to cooperate. While as they say innocent until proven guilty, there is a much better case for them to get a guarantee than, say, Ray Burke .... who .. um ... pled guilty this week.
