Getting out of a lease?

    I moved into a place in Christchurch in Feb 2002 and signed a 12 month lease. In Feb 2003 the rent went up slightly but I wasn't given or asked to sign a new lease. In Feb 2004 the rent wasn't put up and again I wasn't given a lease to sign.

    What sort of notice should I have to give my landlord if I want to move out now? I'm thinking 1 month would be fine, does anyone know anything about this sort of thing?

    A month tops. Theres no legal contract between you and the landlord as the lease you signed is expired.

    Once your lease has expired your contract is on a month by month basis (assuming you pay rent by the month).

    Yeah, cheers lads that's what I was thinking.

    I paid 1 month deposit and 1 month in advance when I moved in (paid on 23rd of each month). I pay rent monthly so if I hand in my notice on say 22nd July I won't have to pay my rent on the 23rd and I can move out on 22nd August and still get my deposit back.

    Think I'll do that.
