When is a temp contract no longer a temp contract?

    hello. i have been working for my present employer for 12 months now...by the way of a 3 month contract, 6 month and another 6 month contract.

    Someone told me that if you work for a employer for 11 months, they are obliged to make you permanent at this stage or lay you off for a while before re-employing on a temporary basis.

    I would be grateful for some clarification on this. I want to get a mortgage but cannot proceed to do so without a permanent contract of employment. Its very annoying because if i dont get this in my present workplace i want to leave immediately so that i can start working up to permanency with another company.

    Not knowing either way is píssing me off.

    Once you pass the 11/12 month mark you gain pretty much all the rights of a permanent employee. Look at www.entemp.ie

    Thanks for the link victor. That clears up some of the confusion. I must dig out the contract cos the only way that they can be getting away with this practice is if the contract of employment is being classed as a 'fixed term contract' on the basis that they only have work available for this period of time.

    They have already provided the other benefits that they are required by law to provide same as their 'permanent' employees ie. holidays, sick pay, bupa, etc.

    However, this is still screwing my life up as i cant get my mortgage through..and theres no guarantee that they dont turn round and either offload me or give me another fixed term contract again in a few months time :mad:
