    I was called last Thursday by IBB about downloading copyright materials. i was just wondering if anyone else has been called?

    Not me... If you would like to give more details about what APP you were using, and what you were downloading.

    If you want to keep it kinda private, PM me. I'm really interested, as i am also an IBB customer.

    surely they have no access in what your downloading,surely thats not legal itself them lookin what your downloading,

    Of course it's legal! It's their network and also ISP's are obliged by law to keep records of customer activities in case of law suits (for example, someone accused of downloading child porn).

    I doubt they're proactively monitoring downloads, what would be more likely (if this story is even true, which I doubt) is that some organisation like IRMA has contacted them about copyright infringement.

    As do I, but it's still illegal and against the terms and conditions of the contract you sign when you sign up with an ISP...

    why would i lie exactly?

    they phoned me on thursday morning, the phone had been plugged out until saturday night and i only found the message this afternoon...

    also they dont have the right to monitor what you are downloading, just how much and if they want to, from where. Its equivalent to eircom listening in on your phone calls.

    Take a peek at your contract.

    I'm pretty sure that most internet access contracts have a clause dealing with the use of the line for copyright breach or any other illegal activity.

    I'm surprised to hear about this. While I'm sure an awful lot of illegal downloading goes on I have yet to hear of an ISP contacting its customers about it directly.

    here's another interested ibb user, i presume they didn't give up much information in the message. Do let us know what the deal is when you call them. I think they are throttling certain ports on me already, bittorrents tend to grind to a halt during the day and the moment 1am passes they speed off again, every day without fail, I've got mrtg running to keep track of things and it's nuts!

    rob1891 I'm 100% positive that IBB have been throttling me, before Xmas i was getting 30+Kb/s on bit torrent then after Xmas i couldn't connect to peers or seeds, and eventually i couldnt even connect to trackers. I changed to Direct Connect in the end which they now seem to have throttled aswell (all downloads go at no more than 1Kb/s and eventually just stop altogether). I then moved to emule which is always slow and it seemed fine until Thursday when they rang. Ill be calling them later today.

    The service from IBB has been slow and patchy for the last fortnight (see other thread on this). I phoned them and they said they were upgrading my node, and this work would be going on for a while.

    I phoned back to ask how long it would be going on, and was told someone would call me back as soon as they were off the phone; must be a long call, because I think that was last Wednesday.

    I believe Netsource have contacted various customers about downloading copyrighted materials. Of course they may be doing people a favour as its not entirely unlikely that the day will come where Irma will be able to kick in your door and raid your place for copyrighted stuff. As I understand the recent Euro DMCA equivalent act that is due to be passed soon thats the kinds of rights that will be bestowed on copyright holders. I may of course be talking crap but thats what I understood was being rammed through the Euro parliament by one of the MEP's who is married to a music executive.

    The ISP's here apparently get a lot of cease and desist notices from the RIAA and the like about people downloading stuff here. While legally its outside the RIAA's jurisdiction it gets annoying for the ISP and hence they crack down on heavy downloaders of copyrighted stuff.

    Of course they can monitor what you are downloading. They just don't want to in most cases so they can't be sued. Liability rests with the downloader themselves if they can claim not to know about it. In cases where they have been contacted specifically about someone downloading stuff I imagine they want to absolve themselves legally by telling the downloader to stop downloading the copyrighted stuff and if they continue they can terminate the contract for BB.

    They monitor it closer if you use them as a proxy in your apps. Then they have a copy of what you download on their proxy servers.

    They do have a legal right to monitor, and it doesn't qualify under the same law as a phone tap.

    IRMA are really pushing ISPs lately, and plan to issue law suits very soon for people in Ireland downloading copyright music, especially those using P2P apps.

    Beware or you'll be in court soon.

    It turns out that they were contacted by a film company, whoever produced A Beatiful Mind. I was sharing it on Emule.

    yep i got a forwarded email from them from ibb. the only bloody time ibb have ever emailed me inspite of numerous attempts to contact them. i rang them wen one of the towers went down for over a day last week and women told me over the phone that my connection was up and i was downloading-i was like emm i cant even get a webpage up, how can i be downloading? bout 6 hours later she calls to say the tower has been giving errors since the previous day...these guys are full of crap and still havnt given me my router username/password for a router they sold me!!! sorry bit of rant there.

    but yep i got an email bout copyrighted materials too.

    The isp has to do something about the problem once they are notified and the easiest thing for them to do is notify a customer and ask them to stop

    do those that have been contacted like this still share (different files perhaps!)? Does IBB really care what we do ... did they threaten to disconnect you or anything?

    i imagine if u wer to get another warning that wud be final and they they wud do sumthing or else they are facing the prospect of action against themselves by the legal authorites. well thats my guess nyway.

    Piracy is piracy. It's also illegal and a violation of the terms and conditions of service of just about every ISP under the sun.

    Also, the film you were downloading probably sucks.
