Advice need Please

    I have been with a company since October, now Initially I had a sneaky suspicion I was being overpaid...turns out I was, now there are two months left on my contract and a fellow work m8 very stupidly after four months of being overpaid went and made enquiries as to if we were being overpaid.

    So they eventually realise they made the mistake so now with two months to go on my contract, the woman in payroll is trying to cover her ass and she wants to deduct what we have been overpaid, over the two coming months.


    Can they simply decide how much they want back in what time frame they decide


    What I want to know is 1. do I have a legal obligation to give it back, 2. I am willing to give it back, simply not over the space of two pay cheques but in a time frame i can manage

    What are my options here?

    I would greatly apreciate any advice from those who have been in such a predicament before.

    i suspect from a legal point of biew, you owe them a load of cash.
    the fact that you didnt own up to the fact you were being overpaid may work against you, and claiming ignorance wont be a defence.
    especially if you are only there on a contract.

    the company does have the right to reclaim the money, although they are not allowed to take money from you without your agreed permission. which means you have to come to some sort of agreement on how the situation will be resolved.
    you may have to pay it off over a period of time suitable to you, or they may let you away with it, depending on how the ocmpany view it, but if it comes legal proceedings, i suspect you havent a leg to stand on due to the length of time taken to tell them youa re being over paid.

    of course, im not a lawyer.....
