    what are they? why are they and more questions, why do bands have them. how different is it to a record deal, and what org's offer them.

    i've heard www.gigsmartireland.com do publishing deals and a mate of mine sorted out a publishing deal with the Irish Music Network (website address anyone?) and do Thumped do something along those lines

    A publishing deal is for the management of your song copyright. If you wrote a song, you own the copyright to that song. If someone else wants to record it (or rerecord it as a cover, for example) they need your permission to use the song. When their recording is sold you get the publishing royalty. Similarly, when the song is performed by another band, or through any public forum (for example radio or over a PA in a public place) you theoretically get paid a royalty for it. As does the copyright owner of the recording in the case of radio or the cd being played over PA. When you sign a publishing contract you are giving a publishing company the right to negotiate the sale of the licence to your song or songs on your behalf. The company takes a percentage of your song copyright royalties. The company may actively seek to sell your song, making it far more likely to get used as a cover, or to appear in a film, tv program, or advertisment.

    There's no point in signing publishing with a small company as they'll be able to offer you little more than you can do for yourself.

    No, Gigsmart certainly do not. Though they are now a registered Label and Distributer apparently. Which would mean they can sign Record Deals and Distribution Deals.

    gigsmart are not a label, they have a limited capacity for Distrobution though. So if you are looking to release something you have done yourself, its worthwhile to give them a shout

    Yo're confusing your terms slightly. Gigsmart can now act as a DISTRTIBUTOR a label entails a range of functions which we do not fill at this moment in time (though watch this space...).

    GigSmart has secured a distribution deal with HMV only, we cannot distribute CD's to Golden Discs or Virgin, we can get CD's into numerous independent stores but then again so can anyone.
    As regards the Label, GigSmart had to be set up as a label when releasing the Compilation CD, so technically speaking we are a label but its very much on a small capacity and we don't sign recording deals for artists.
    We merely help bands with gigs and in some cases tours and distribution of their CD's.

    On the contrary, I used the terms exactly as they appeared in the gigsmart annoucement. Perhaps people should be more careful what they claim, since it appears they are neither a label nor a distributer.

    It was stated on the GigSmart that we have secured a distribution deal with HMV, we never mentioned Virgin or Golden Discs, but still only if it is one of the major stores that deals with us, it still gives us a hand in distribution, the label that the GigSmart Compilation CD was released with was GigSmart so we are offically set up as a label also but we don't sign people to our label, we release our own releases through our own label thats all for now.
    It was a big accomplishment for us, but this thread is kind of asking the question, who do we go to if we want to sign a distribution contract or a recording contract.
    Our name was put forward and I am here to say that we are on a smaller playing field and more than likely we couldn't help you in the magnitude that you want us to.
    I am very careful about the statements that I make, just its on a smaller scale than what is requested here.

    I don't think anyone was making any requests, Niall. My statement "Which would mean they can sign Record Deals and Distribution Deals" was not a claim or implied belief that you would in fact do anything of the sort, more of a statement of the curious technicality which arises from the fact. You all seem remarkably touchy on the subject, so I'll let it lie.
