State says dads won't get same custody rights as single mums

THE Government has told the UN it does not believe it should give men the same rights as women in relation to the guardianship, adoption, and custody of children born out of wedlock.

The Government stance is in relation to a UN convention aimed at eliminating all forms of discrimination against women.

Under Article 16 of the Convention, member states are asked to ensure there is equality between men and women; that they have the same rights and responsibilities as parents in matters relating to their children, irrespective of their marital status; and that, in all cases, the interests of the children are paramount.

It also states that men and women should have the "the same rights and responsibilities with regard to guardianship, wardship, trusteeship, and adoption of children".

However, at the end of a 141-page report the Irish Government has told the UN that it is of the view that fulfilling the objectives of the Convention does not "necessitate the extension to men of rights identical to those accorded by law to women in respect of the guardianship, adoption, and custody of children born out of wedlock and reserves the right to implement the Convention subject to that understanding."

The Government has also said it has reservations about parts of Article 11 in relation to eliminating discrimination against women in employment.

The sections include those calling for the right to the same employment opportunities, including the application of the same criteria for selection; the right to free choice of profession and employment; the rights to promotion, job security, and all benefits and conditions of service; as well as the right to receive vocational training and retraining.

A further section about which it has reservations governs the right to equal remuneration, including benefits and equal treatment in respect of work of equal value and equality of treatment in the evaluation of the quality of work.

The Government adds that it reserves the right for the time being to maintain Irish legislation which, in respect of social security measures, is more favourable to women than men.

The Government said it was giving consideration to supplementing the guarantee of equality contained in the constitution with special legislation governing access by women to financial credit and other services, as well as recreational activities, where these are provided by private persons, organisations, or enterprises.

My cousin did a paper on this for his thesis. Basically outlining the rights, or lack of, for unmarried fathers..

Was published there a few months back..

According to what he had found their rights are almost non existant in Ireland... and this just confirms it...

You have to admire their honesty though. How often have we heard one thing and wind up with something else? But I can't believe that they are actually saying it and want to go ahead with what is undeniable sexist. It's crazy because nearly all the TDs are men...

Amazing, the bloody brass neck must be some weight. THe mentality of the powers that be in this state is at heart still Victorian. Trouble is not much can be done short of a revolution.
Or many trips to the European Court of Human Rights.

    Mike.
