Eircom & ComReg in court next year / New EU directives

    The Irish Times reports that a legal challenge by Eircom to the communications regulator ComReg is expected to be heard by the High Court early next year. Eircom has challenged the regulator's decision to reduce the charges Eircom charges its competitors for use of its local access network. The article said that Justice Kearns on Thursday issued directions for the exchange of documents between the sides in preparation for the trial. He also refused an application by the regulator for the discovery of certain documents from Eircom.

    The [Irish Independent] reports that telecoms operators in Ireland, from mobile phone firms to TV and cable companies, could be hit with "substantial fines" if they breach their obligations in the future, as part of new EU directives signed into law on Thursday, according to the Department of Communications. Up to now, a maximum fine of EUR3,000 was enforceable by ComReg but the new provision means that the regulator will propose new fines which will then be decided by the High Court in the case of non-compliance. The Minister for Communications Dermot Ahern is also to examine with the office of the Attorney General the creation of indictable offences for breaches of regulatory obligations and possible legislative provisions.
