    I'm not sure if the assertion that this is the first such case is true. AFAIK there have been previous cases of pubs getting done for charging for tap water (under the Constitution all water belongs to the state).

    A DUBLIN pub is the first in the country to be fined for overcharging for water in a case taken by the Director of Consumer affairs (DCA).

    The Anglers' Rest at the Strawberry Beds, Chapelizod, was yesterday fined €508 by Dublin Circuit Criminal Court for overcharging for bottled water and failing to display a price list.

    Judge Desmond Hogan said that, in view of the evidence, he would regard the offending as "an honest mistake" and impose mitigated fines of €127 on each of four charges relating to checks carried out by an inspector in 2000. He also agreed to award costs of €1,500 against the pub owners, Howth Railway Refreshment Rooms Ltd, in favour of the DCA at the request of prosecuting counsel Patrick McGrath BL.

    The company pleaded guilty to two charges of not displaying price lists as well as to one each of charging more than was authorised during a statutory freeze on pub prices and charging Ir£1.55 instead of the listed price of Ir£1.45 for water.

    Philip Duggan, DCA inspector, said when he visited the pub on August 2 and October 4, 2000 he found it did not have price lists displayed. On November 2, 2000 when there was a statutory price freeze the Angler's Rest was charging £1.55 for a small bottle of water, which was listed at £1.45.

    Mr Duggan agreed with David Bulbulia BL, defending, that the staff and management were civil and co-operative.
