Grand Parents to take down and rebuild Garden Wall

    Hi my Grand Parents recently got planning permission to take down and replace one of our garden walls.

    It is a two layered red brick wall and we will be taking them down to put in a solid concrete block with a red brick on the outside.

    The problem is that there is an alleyway on the other side of the wall. People often use it as a short cut to get out of the estate quicker.

    My question is if we do go ahead with taking down the wall and replacing it, who is responsible for the (red brick) alleyway side, my grand parents or the county council.

    It’s a boundary wall so no planning required. Just civil agreement between the 2 owners. You may have to close the lane way temporarily while you are doing the works.

    Generally, whoever wants the works done is responsible for carrying them out, unless there is an agreement in place for the other owner to carry out/pay for half the works, even if one of the owners in the Local Authority.

    It's a good idea to talk to the area engineer before starting works, they may even provide hoardings/fencing/sinage that would otherwise end up costing your grandparents extra.
