Appealing maternity benefit decision

    Looking for some advice or opinions please. I was pregnant last year - at 29 weeks, I went into labour early. Our beautiful daughter passed away within 2 hours of her birth. To say we were devastated would be an understatement. I have been in full time employment for 10 years (since I graduated college). The maternity benefit form had not been submitted yet at that point - I still had another 7 weeks so I just wasn't prepared for what happened.

    To cut a long story short, I rang revenue (actually my husband did as I wasn't up to it) and explained what had happened. They said just get the forms in by six months after our daughters birth and we would be fine. This form needs to be filled out by the consultant first (done) and then by the payroll department in my office.

    I sent the paperwork to my office which is a large Irish bank with a centralised payroll office. They lost it. I had a sheepish call after about three weeks to explain that it must have been misfiled internally. We had to start from scratch again and resubmit everything getting all parties to sign off. As a result my maternity benefit firm was 4 weeks late.

    I have received a letter saying that I have been refused my maternity leave payment. When I rang I was told it was entirely due to being late and it was "out of their hands". The letter has advised that I can appeal in writing within 21 days.

    I am wondering if anyone can offer me advice - should I explain all of the details or am I wasting my time as truthfully I should have organised it sooner. If I do appeal, is it a case of waiting for at least a year for an outcome?

    You have nothing to lose in submitting an appeal, it won't cost anything.
    Sorry to hear of your bereavement.
    I would be quite optimistic about a positive response
    Write to the Appeals Office in D'Olier St stating that you wish to appeal the refusal on the following grounds... then tell your story. Stress your employers miss handing of your application as the main reason you were late.
    Don't forget to include a copy of the letter of refusal .
