Warranty, what does it cover?

    Got a car 6 months ago with a 12 month warranty. There's a box ticked that says it doesn't cover wear and tear items like clutch and flywheel.

    Isn't everything on a car a wear and tear item, though?

    Anyone ever take a legal challenge against this, to get something repaired under warranty that the garage says isnt covered?

    Wear & tear is such a horrible choice of words, it should probably say consumables - stuff you know you'll have to replace during the lifetime of a car like tyres, brakes pads/shoes/discs, timing belt, bulbs, air filters, oil filters, wipers, fuses, CV boots etc.

    Things not considered consumables: Your ECU, radiator, fixtures like door handles, locks, electric motors (e.g. window and wiper motors), body panels and many, many other parts.

    If you try to get something replaced under warranty and the garage refuses you can probably take them to the small claims court to fund the repairs.

    If you only got a 12 month warranty, its probably a second hand car and only certain items may be covered, including engine and transmission. It may not cover things like window regulators, exhaust, electrics etc. Check the fine print.

    You'll have a warranty document that clarifies exactly what is and isn't covered. Clutches are never covered, unless the failure can be shown to have been as a result of a manufacturing fault. The reason for this is that anyone can destroy a brand new clutch in a matter of minutes.

    Yeah, the warranty document says engine and gearbox only. The box saying that wear and tear items aren't covered is ticked and initialled.

    The flywheel is on the way out, and it's mentioned as an example of a wear and tear item.

    Just wondering what's the legality of ticking and initialing that box, though. The implications of it weren't explained at the time of purchase. Can it be challenged on that basis?

    You accepted the car under the dealers terms when you paid for it, this is a contract and they do not have to honour anything outside of what the warranty states.

    A flywheel is a normal wear and tear item on any modern diesel - unfortunate but that's how it is.

    I'm afraid I don't think you have no basis for any legal challenge here (but I'm no lawyer so get your own legal advice if you feel it necessary).

    I know it's getting like America where everyone wants to sue everyone else at the drop of a hat, but have you tried discussing it reasonably with the dealer?
    Maybe they'll be willing to meet you part of the way on it, or give you a discount on the next service or something.
