5 year planning extension

    Just wondering does it matter whether works have started or not on a development when applying for this extension of duration.

    Will they still give ful 5 year extension even if works have commenced?

    So long as the application for a duration is made in the 12 month period prior to the expiration of the permission.

    Its the same form that's used regardless of work having commenced or not. There are different questions on the application form to cover both situations.

    I see on the mayo Co Co. form, they ask - If Commenced, give details of substantial works completed.

    Thats why I wondered if commenced did they want to wallplate etc? as opposed to non commenced or would they only grant a shorter extension

    Up until August 2010 "substantial works" had to be carried out before you could make an application to extend the duration. Now, "substantial works" isn't defined in the P & D Acts so its down to the interpretation of the Planning Authority or indeed the individual planning officer. I recall (a long number of years ago) applying for and getting the 5 year extension when the founds were the only works completed.

    Its a sort of a rule of thumb that works up to wallplate would be acceptable by most if not all PA's. Sill level would probably be acceptable but as I said its down to the individual planner and indeed their current development plan as opposed to the content of the DP when permission was originally granted.

    PA's can of course grant a reduced period. An example of this here in Donegal was the local football club, Finn Harps, who looked for a 5 year extension of their PP for a new stadium but were only granted 30 months.
