Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

What does the 483 "other" refer to?
The category of other firearms in the table includes firearms as defined under the Firearms Acts such as, humane killer, starting gun and blank firing gun.

And presumably crossbows, silencers, etc, etc, etc...

It seems bizarre when 1700 firearms are reported as stolen nearly 500 are "other"

Brendan Griffin (Kerry South, Fine Gael)
    351. To ask the Minister for Justice and Equality the position regarding plans to review firearms licensing; and if she will make a statement on the matter. [9286/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

In light of public safety concerns highlighted by An Garda Síochána, a joint Department of Justice and Equality/ An Garda Síochána Working Group was established by the Department of Justice and Equality to review firearms licensing. The report of this Working Group was published on 13 November 2014 and submissions on the report were sought from stakeholders and the public by 31 January 2015. The consultation process gave individuals and groups an opportunity to contribute to the development of firearms policy and legislation and will enable consideration to be given to the future direction of such legislation.

The submissions received are currently being examined and incorporated into a report for me. The Oireachtas Committee on Justice, Defence and Equality has also sought submissions and held hearings with interested parties in relation to the Working Party report. It is expected that their report on the issue will be available shortly.

I have already given a commitment that I will not make any final decisions until I have considered all the submissions which have been made and have met the key stakeholders, including the organisations who represent those who use firearms for sporting purposes. These meetings will take place following receipt and consideration of both my Department’s and the Oireachtas Committee reports.

    Niall Collins (Limerick, Fianna Fail)
    331. To ask the Minister for Justice and Equality in view of the report by the Garda of some 1,700 firearms reported stolen, in the years 2010 to 2014, which includes 17 handguns and 40 air pistols, the number of those 17 handguns which were licensed to firearms licence holders at the time of the theft; and the number stolen from the licence holders’ homes; and if she will make a statement on the matter. [9138/15]

    332. To ask the Minister for Justice and Equality in relation to the 40 air pistols reported by the Garda to have been stolen, in the years 2010 to 2014, the number that were licensed to firearms licence holders at the time of the theft; the number stolen from the licence holders’ homes; and if she will make a statement on the matter. [9139/15]

    333. To ask the Minister for Justice and Equality in relation to the 40 air pistols reported by the Garda to have been stolen, in the years 2010 to 2014, the number that were airsoft pistols stolen from the licence holders’ homes; and if she will make a statement on the matter. [9140/15]

    334. To ask the Minister for Justice and Equality in relation to the 17 handguns and the 40 air pistols reported by the Garda to have been stolen, in the years 2010 to 2014, the number stolen from premises other than licence holders’ homes, for example, club premises, firearms dealers' premises or from the homes or premises of persons who were not the licence holders; and if she will make a statement on the matter. [9141/15]

    335. To ask the Minister for Justice and Equality the number of the 1,700 firearms reported stolen, in the years 2010 to 2014, which were unlawfully taken from places or premises, to which the provisions of Statutory Instrument No. 307 of 2009 Firearms (Secure Accommodation) Regulations 2009 expressly applied at the time of the thefts; and if she will make a statement on the matter. [9142/15]

    336. To ask the Minister for Justice and Equality the number of the 1,700 firearms reported stolen in the years 2010 to 2014, that were crossbows, replica firearms, blank-firing firearms and de-activated firearms and if she will make a statement on the matter. [9143/15]

    337. To ask the Minister for Justice and Equality the number of the 17 handguns reported stolen that were replica, humane killers, flintlocks, blanks and de-activated firearms. [9144/15]

    338. [9145/15]

    339. To ask the Minister for Justice and Equality if any of the 17 handguns reported stolen were air pistols, within the meaning of the Firearms Acts; if so, the number of same; and if she will make a statement on the matter. [9146/15]

    340. To ask the Minister for Justice and Equality the number of the 17 handguns reported stolen that were centrefire guns; rimfire guns; and if she will make a statement on the matter. [9147/15]

    341. To ask the Minister for Justice and Equality if any of the 40 air pistols reported stolen were airsoft pistols, within the meaning of the Firearms Acts; and if she will make a statement on the matter. [9148/15]

    342. To ask the Minister for Justice and Equality in view of the 1,700 firearms reported as stolen, in the years 2010 to 2014, 753 of which are unaccounted for, and given that it is not revealed what type they are, if she will provide a breakdown of this figure; and if she will make a statement on the matter. [9149/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I propose to take Questions Nos. 331 to 342, inclusive, together.

The Deputy's questions relate to information provided by An Garda Síochána in response to Parliamentary Questions seeking information regarding the numbers of firearms reported stolen over the past five years. The figures relate to licensed and unlicensed firearms stolen over the period, including those stolen from Firearms Dealers. The information from the Garda PULSE system which was used to compile this information follows. This information from PULSE cannot be amended or updated for statistical purposes. As indicated in response to the Deputies the total figure for firearms stolen of 1,710 between 2010 and 2014 includes 483 items in the category of Other, which includes humane killer, starting gun and blank firing gun.

I note some of the Deputy's questions relate to firearms stolen from licensed owners and how many of these guns stolen may, for example, be replicas or humane killers or deactivated firearms.

The table below gives details of firearms linked to a licence recorded as stolen over the years 2010 to 2014 inclusive, with yearly totals for rifles, shotguns and handguns.

    Type|2010|2011|2012|2013|2014|Total
    Rifles|42|68|65|60|41|276
    Shotguns|176|206|163|170|111|826
    Handguns|2|2|1|2|-|7
    TOTAL|220|276|229|232|152|1,109

The research required to compile the other information sought by the Deputy would require a disproportionate expenditure of time and resources, which cannot be justified in current circumstances where there are other significant demands on resources.

It's hard to point to any one PQ over the last few years and say "This one is the most significant", but this is definitely a contender for the sheer amount of raw data it's made available. (So I put it in a spreadsheet, attached to this post. Enjoy)

Interesting that Gun Safes are classed as firearms in the statistics, There also seems to be 105 instances of cartridge thefts totaling 266 rounds. :(

A telescopic sight is a firearm???????

A toy gun is a firearm????????

    A gunsafe is a firearm?????

    What's a gas gun?

And I saw an automatic rifle on the list????

    ^^^^^^^^^^^^^^^

    Just thinking the same.

Scopes are firearms? No license needed, not even authorisation.

Toy gun, imitation gun, paintball gun. All classed as firearms stolen yet none require a license (regardless of the legal standing of paintball guns).

Once again we see the statement of "It'll cost too much" when asked about other statistics. My point would be if you cannot be bothered to get the stats (other than it meaning you don't have them) then how can any statement in relation to those items be considered as relevant, accurate or even legally be allowed to be said as it'd be best guess. IOW a pure guess.

Scopes can be firearms legally. Paintball guns not only need a licence, they're restricted short firearms.

    How?

I know, but as i said above they are not making them license them so it's either a firearm or not. It cannot be a firearm when using it as a stick to beat us with about stolen firearm numbers, and then let the weekend warriors run around shooting each other with illegally held, restricted firearms without batting an eyelid.

I thought that night vision and thermal scopes need permission but aren't actually regarded as firearms under the law?

    Am I wrong?

    In the section 1 definition:
    (i) telescope sights with a light beam, or telescope sights with an electronic light amplification device or an infra-red device,

So technically, it could be valid.
I'd be surprised if it was though.

If a rifle with a telescopic scope is stolen, does that count as two firearms under these stats then?

Sure looks like some were counted twice allright... and even three or four times if they counted the safe and ammo, but they're not legally firearms.

A scope is not a firearm, even if it's IR, NV, Laser designator, etc. and it's not a component part of the firearm as the firearm will function perfectly fine without it. It only requires authoirsatiion if it is IR/NV, etc. and going to be fitted to a firearm.

    (i) telescope sights with a light beam, or telescope sights with an electronic light amplification device or an infra-red device, designed to be fitted to a firearm specified in paragraph (a), (b), (c) or (e)
    Namely:
    (a) a lethal firearm or other lethal weapon of any description from which any shot, bullet or other missile can be discharged;

    (b) an air gun (which expression includes an air rifle and an air pistol) or any other weapon incorporating a barrel from which metal or other slugs can be discharged;

    (c) a crossbow;

    (e) a prohibited weapon as defined in section 1 (1) of the Firearms Act, 1925 ;

Yeah, but if you get a scope designed to be fitted to a rifle and it has a light attached to it, you could legally call it a firearm. You'd have to be hugely under-utilised as a Garda to do so, but you technically could.

Gun safes, ammunition and toy guns and imitation guns on the other hand, legally are not firearms and yet I suspect these figures were presented by AGS to the Dail as being the number of stolen firearms.

I think that an AGS officer presenting data that wonky to the Oireachtas does kindof raise a question or two... which is why I'm ignoring even the really edge cases of what might be a firearm and looking only at the stuff that specifically cannot be one.

I understand and appreciate where you're coming from and my questioning is more so to highlight the incompetence of the AGS/DoJ and the law itself.

If i buy a NV scope i can do so without a firearm or firearms license. The only legal issue comes around when i attach it to a firearm. Then it falls under section 4(2)(g)(i) as a component part.

No, you can buy an NV monocular or something not designed to go on a firearm. If it's designed to go on the firearm it becomes a firearm under the law, regardless of whether or not it's ever attached to on.

And yeah, this law's an ass all day long...

Not meant as it sounds, but Feck off !!!!!!!!!!!!!!!!!!!

As long as iv'e being doing this i never knew that. So you buy a NV scope, have no firearm, and no firearms license and you're in breach of the firearms Act/1990 offensive weapons act?

Anyone know where there is a good ring because i've a towel to throw. I mean in the face of that how can you expect to make rational arguments with those that write, and pass these laws?

Yup, exactly the same as if you bought a silencer.
Or one of these this xmas.
Or, technically, if you bought an m4 bolt off Woodies.

That's not even the worst part.

There are two conflicting definitions for firearm in Irish law. One in the Firearms Act, one in the Criminal Justice Act 2001. There's no definition for target shooting anywhere in the law. But possession of the former or taking part in the latter outside of a range, is an offence under the law that can carry a jail sentence as punishment.

    312. Deputy Gabrielle McFadden asked the Minister for Justice and Equality the system in place to test unproofed guns imported into the market here; the quality control process in place here when it comes to the import of guns into Ireland; and if she will make a statement on the matter. [9997/15]

    342. Deputy Gabrielle McFadden asked the Minister for Justice and Equality if the Firearms (Proofing) Act 1968 makes provision for a proof house to test unproofed guns for non-military use imported into the Irish market, including guns for retail; if a proof house is required to ensure the proper testing of unproofed guns for non-military use, if one does not exist to ensure they are made to a standard and that they are safe to enter the public domain; the way guns imported into this country, are currently proofed; and if she will make a statement on the matter. [10469/15]

    343. Deputy Gabrielle McFadden asked the Minister for Justice and Equality her views that there are sufficient quality controls in place to safeguard against sub-quality standards of guns for non-military use being imported into the market here, including guns for retail; and if she will make a statement on the matter. [10470/15]

    344. Deputy Gabrielle McFadden asked the Minister for Justice and Equality Frances Fitzgerald her views on the Republic of Ireland becoming a member of the Commission Internationale Permanente pour l'épreuve des armes à feu portatives CIP, an international organisation created by way of an international agreement, established on 15 July 1914, modified 1969 (details supplied); and if she will make a statement on the matter. [10471/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):

I propose to take Questions Nos. 312 and 342 to 344, inclusive, together.

The Firearms (Proofing) Act 1968 was introduced by the then Department of Industry and Commerce (now the Department of Jobs, Enterprise and Innovation (DJEI), to set up a proof house specifically for shotguns manufactured by an indigenous firearms company that was being part-funded by State Aid. I understand the gun company subsequently went into liquidation and the proof house at the Institute for Industrial Research Standards (IIRS) - the predecessor to the National Standards Authority of Ireland (NSAI) - ceased to function at the same time.

Firearms proofing is a safety matter with regard to the production and use of a firearm and is normally carried out at the point of manufacture. To establish a proof house in Ireland is a matter ultimately for the Minister for Jobs, Enterprise and Innovation. Such a measure would only be viable if there was a domestic manufacturer of firearms.

Many firearms imported into Ireland come from the 14 countries which are members of the Commission Internationale Permanente pour l'épreuve des armes à feu portatives (CIP). This means the firearms produced in those countries have a CIP proof mark, which essentially relates to a common standard for mutual recognition of proof marks. Countries such as America and Canada are not members of CIP and their manufacturers test and proof mark their firearms according to their own standards. Firearms from these non CIP countries are imported into Ireland. Responsibility concerning product safety of firearms is a matter for manufacturers, the individual consumer and the firearms dealer who imports firearms. Many EU countries, including Ireland, do not have domestic firearms production, and are not members of the CIP. In the absence of sector specific EU legislation on the product safety of firearms, the product and consumer safety issues relating to firearms fall under the General Product Safety Directive (GPSD) 2001/95/EC of the European Commission. The responsibility for the implementation of this Directive (including related market surveillance and enforcement issues) rests with my colleague, the Minister for Jobs, Enterprise and Innovation.

    345. Deputy Catherine Murphy asked the Minister for Justice and Equality if her attention has been drawn to the fact that some considerable doubt has been cast over the accuracy of statistical crime data prepared by An Garda Síochána for the Central Statistics Office; if she has read the Garda Inspectorate's recent report, which uncovered evidence of actual crimes being reclassified as non-crimes; her views on the significant problems that inaccurate crime data will have for effective policing and deployment of resources; the steps she will take to address this serious matter; and if she will make a statement on the matter. [10496/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):

I can assure the Deputy that I am familiar with the Garda Inspectorate Report's analysis of the issues she refers to and welcomed its examination of these matters on publication. As the Inspectorate report recognises, these issues have been reported in other police services and the Inspectorate's recommendations draw from measures introduced in those jurisdictions.

It is of course of great importance that police data is as accurate as can be and this is reflected in the steps taken by the Garda Commissioner to respond to the concerns identified in the Inspectorate report, including the establishment of a new Data Quality Team in the Garda Information Services Centre (GISC), as well as measures to strengthen PULSE governance arrangements. These measures form part of broader steps to take forward the Inspectorate’s recommendations, including plans to upgrade and improve the technology for recording of crime and policing activity.

In so far as the compilation and publication of crime statistics is concerned, this is a matter in the first instance for the Central Statistics Office, as the national statistical agency. The CSO is currently carrying out a detailed analysis of certain issues raised by the Inspectorate in relation to the recording, classification and reclassification of crime, to see whether and to what extent they may have implications for the crime statistics which that Office produces. I understand that substantial work has been carried out on this project since the report's publication, and that this work is ongoing.

In addition, the CSO has also agreed to chair an expert panel to examine the Inspectorate's recommendations on crime statistics. The expert panel will review the crime counting and detection rules, as recommended by the Inspectorate, with a view to introducing new national standards. I am advised that the expert panel will commence its work in the coming weeks.

This isn't specifically to do with us, but given the stuff that turned up in the 1700 stolen firearms statistic...

    24 March 2015
Terence Flanagan (Dublin North East, Independent)
    469. To ask the Minister for Justice and Equality the action being taken to address the increase in the number of unlicensed firearms here; and if she will make a statement on the matter. [11475/15]
    470. To ask the Minister for Justice and Equality her views on incorrect information that was provided to her and the Oireachtas Joint Committee on Justice, Defence and Equality regarding the number of licensed firearms stolen from 2010 to 2014; and if she will make a statement on the matter. [11476/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I propose to take Questions Nos. 469 and 470 together.

The Deputy refers to the increasing number of unlicensed firearms in the State. It is however impossible to accurately state how many illegal firearms are currently in the hands of criminals in the State or whether this figure is increasing. An Garda Síochána tackles the issue of illegal firearms on a daily basis at both local and national levels and in recent weeks alone have successfully removed a number of illegal firearms from criminal hands in ongoing operations throughout the country.

Gardaí tackle the issue of illegal firearms through a range of targeted and intelligence based operations, often disrupting and preventing incidents, as well as detecting and prosecuting those involved.

Heavy penalties are provided for weapons offences in our criminal law and mandatory minimum penalties have been introduced for certain firearms offences. The considerable powers already available to Gardaí have been supplemented further by the DNA Database legislation enacted last year, which provides for the establishment of a Database which will have the capacity to link suspects to unsolved crimes using forensic evidence, and will greatly assist Gardaí in investigating a whole range of serious offences.

The various Garda operations which target armed and organised criminals are complemented and supported by Garda engagement with local communities, including a range of community local fora, to address local concerns relating to crime, community safety and the impact of organised crime on community life.

The Deputy also refers to what is described as incorrect information provided to Oireachtas members regarding the number of licensed firearms stolen. The statistics provided by An Garda Síochána regarding firearms reported stolen is provided on the basis of data available on the PULSE system. The data available cannot be amended or updated for the purposes of providing statistics. I can also inform the Deputy that different types of questions were asked by Oireachtas members in relation to stolen firearms. One set of figures provided, totalling 1,710, was for all firearms reported stolen between 2010 and 2014. This figure would include firearms not licensed stolen from firearms dealers and other items classified as firearms such as humane killers, starting guns and blank firing guns which would be held on authorisation rather than licence. Another set of figures provided, totalling 1,109, was for all firearms linked to a licencerecorded as stolen between 2010 and 2014.
    Fergus O'Dowd (Louth, Fine Gael)
    465. To ask the Minister for Justice and Equality her views on a matter (details supplied) regarding gun control; and if she will make a statement on the matter. [11419/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I understand the Deputy is referring to a recent Prime Time programme which had a report on firearms licensing. The Deputy will appreciate that I have no role in adjudicating on whether broadcasting codes or rules have been broken.
However, I am advised that under the Broadcasting Act 2009, viewers and listeners can complain about broadcasting content which they believe is not in keeping with broadcasting codes and rules. In line with the complaint process, the viewer or listener should direct their complaint to the broadcaster in the first instance with regard to the broadcaster's Code of Practice for Handling Complaints, a document which each broadcaster has available on its website. If a viewer or listener is not satisfied with the response from the broadcaster or if the broadcaster does not respond within the timeframe provided for in their Code of Practice (usually 21 days), then the viewer or listener can refer the complaint to the Broadcasting Authority of Ireland for consideration.
Tony McLoughlin (Sligo-North Leitrim, Fine Gael)
    461. To ask the Minister for Justice and Equality her Department's estimates at present in relation to the number of illegally owned firearms; her plans to seize these illegal firearms; and if she will make a statement on the matter. [11393/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

It is impossible to accurately state how many illegal firearms are currently in the hands of criminals in the State.

The details of intelligence based operations targeting illegal firearms cannot be made public for operational reasons.

Jerry Buttimer (Cork South Central, Fine Gael)
    460. To ask the Minister for Justice and Equality when she will receive a report on the submissions relating to a joint report by her Department and a working group in An Garda Síochána that is reviewing firearms licensing; if consideration will be given to the views and submissions of all stakeholders, including groups representing those who use firearms for sporting purposes prior to making any final decision regarding changes in the licensing system; and if she will make a statement on the matter. [11378/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

In light of public safety concerns highlighted by An Garda Síochána, a joint Department of Justice and Equality/An Garda Síochána Working Group was established by the Department of Justice and Equality to review firearms licensing.

The Oireachtas Committee on Justice, Defence and Equality has also sought submissions and held hearings with interested parties in relation to the Working Party report and will publish its own report on the matter. I have already given a commitment that I will not make any decisions until I have met the key stakeholders, including the organisations who represent those who use firearms for sporting purposes.
    Niall Collins (Limerick, Fianna Fail)
    428. To ask the Minister for Justice and Equality further to Parliamentary Question Nos. 331 to 342 of 3 March 2015, the number of the 276 rifles which she stated were stolen from 2010 to 2014 which were centre-fire rifles; the number which were rim-fire; and if she will make a statement on the matter. [11154/15]
    429. To ask the Minister for Justice and Equality further to Parliamentary Question Nos. 331 to 342 of 3 March 2015, indicating those firearms which were linked to a firearms licence, if she will confirm the 40 air pistols listed as stolen in the Parliamentary Questions were therefore not in fact licensed or linked to a licence; in those circumstances, if she will indicate where these air pistols were stolen from; and if she will make a statement on the matter. [11155/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I propose to take Questions Nos. 428 and 429 together.
I have asked the Garda Commissioner for a report in relation to these matters and will write to the Deputy as soon as I have further information.

Sparks you made a mistake. You pasted the minister's response to Terence Flanagan as her response to Fergus McLoughlin. Oh wait, you didn't. She gave the exact same response. Word for word to both deputies. Same as her response to Jerry Buttimer. How can she be allowed to repeat the same non sensical answer as though it was an answer?

Niall Collins in there again with a very direct and precise question (wonder where he got the idea from :D). I notice there was no "scripted" response to that question. Be interesting to see what reply he gets, if any, considering it took six months to get an answer to the numbers question and even that was balls-ed up.

One thing that does annoy me, In her "copy and paste" reply the Minster says that An Gardaí have considerable powers, endless legislation, DNA database, etc. to tackle gun crime. If the law so appropriately covers all eventualities then:
    • Why are they seeking further restrictions?
    • If they are so successful in removing illegal guns "from the streets" then why the need to remove ours?
    • If no number can be given why are An Gardai and the likes of McGrath allowed to spout 150,000 as though it were fact?
    • Why can they not just say "we don't know" and leave the guessing out of it?
    • Why did the Minster quote PULSE as though it were some sort of impeccable source when the Garda Inspectorate, and all shooting groups, have shown the system to be wholly outdated and severely lacking when it comes to recording accurate information as well as referencing for statistics.

    31 March 2015
Deputy Gabrielle McFadden asked the Minister for Justice and Equality the average length of time it takes her Department to process import and export licences for non-military guns; the criteria required for an applicant to secure a continuous export licence; and if she will make a statement on the matter. [13143/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):
My Department takes, on average, 10 working days to issue an import / export licence for firearms. Firearms Dealers registered with my Department routinely apply for transfer documents / export licences to remove specific firearms from Ireland to another jurisdiction within the EU. The Department of Jobs, Enterprise and Innovation process applications to export firearms to Non EU countries.

The main legal provisions governing the export and removal of firearms from the State are Section 16 of the Firearms Act, 1925 and Regulation 6 of the EC ( Acquisition and Possession of Weapons and Ammunition) Regulations 1993, as amended. In effect, this means that a firearms dealer exporting firearms must obtain a removal order from the relevant Garda Superintendent for the specific firearms being removed and then an application can be made to my Department for a transfer document/ export licence. This requirement of a removal order applies to both specific export licences and a Continuous Export Licence (CEL). An application for a CEL is judged on its merits. A CEL is issued in exceptional circumstances to a very limited number of dealers who have high volumes of trade within the EU for a period not exceeding three years.

    138. Deputy Bernard J. Durkan asked the Minister for Justice and Equality the extent to which she is aware of the strong opposition from various sporting and gun clubs to proposals and restrictions in respect of guns available to the sporting sector, in view of the fact that the statistics would indicate that the most serious source of supply of such weapons comes from illegal sources; and if she will make a statement on the matter. [13812/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):
In light of public safety concerns highlighted by An Garda Síochána, a joint Department of Justice and Equality/ An Garda Síochána Working Group was established by the Department of Justice and Equality to review firearms licensing. 139. Deputy Bernard J. Durkan asked the Minister for Justice and Equality the number of legally held shotguns or handguns reported stolen from households in each of the past ten years and in 2015 to date; the extent to which such weapons have subsequently been used in the committal of crimes; the number of gun-related crimes committed, which indicate the use of weapons acquired through other sources; and if she will make a statement on the matter. [13813/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):
I have asked the Garda Commissioner for a report in relation to this matter and will write to the Deputy when I have further information.
    137. Deputy Bernard J. Durkan Iasked the Minister for Justice and Equality the degree to which adequate resources are being made available to an Garda Síochána, to combat the supply of guns to organised criminal gangs; and if she will make a statement on the matter. [13811/15]

Minister for Justice and Equality (Deputy Frances Fitzgerald):
As the Deputy will appreciate, the Garda Commissioner is responsible for the distribution of personnel, among the Garda Regions, Divisions, and Districts. Garda management keep this distribution under continuing review in the context of crime trends and policing priorities so as to ensure that the best possible use is made of these resources.

The An Garda Síochána Policing Plan for 2015 sets out the continued commitment of An Garda Síochána to pro-actively target groups and individuals engaged in serious crime in all its forms, in particular violent crime and organised criminal activity. Members of An Garda Síochána continue to utilise all available legislation, including the additional legislative provisions introduced by the Oireachtas in 2009 which amended the Criminal Justice Act, 2006 relating to organised crime.

Europol have identified the need for a community wide approach to help tackle Organised Crime Groupings including law enforcement, customs, business interests and government policy. An Garda Síochána are acutely aware that the targeting of Organised Criminal Groupings is best advanced by using multi-disciplinary approaches to ensure the activities of individuals and groups are effectively targeted. This includes the use of the Proceeds of Crimes Legislation including money-laundering legislation and the powers of the Criminal Assets Bureau.

An Garda Síochána also interact with a number of other law enforcement agencies from outside the jurisdiction in the ongoing combating of drugs and firearms trafficking and organised crime on an international level.

Taking cognisance of the target focused operations of both the Organised Crime Unit and the Garda National Drug Unit and the strength that could be gained from combining resources, the Commissioner decided to merge the Organised Crime Unit and the Garda National Drug Unit to create a robust entity, the Drugs and Organised Crime Bureau to effectively tackle organised crime as it currently exists in this country.

The newly amalgamated unit will benefit from the skill sets of both the Organised Crime Unit and the Garda National Drug Unit personnel, in establishing an enforcement and investigative unit which will manage national and international drug trafficking and organised crime investigations.

Organised crime is often transnational in nature, constantly evolving and diversifying to take advantage of the prevailing economic and social conditions; developments in technology; and increasing mobility at a global level. An Garda Síochána continues to develop and implement operations and strategies aimed at targeting, dismantling and disrupting criminal networks, utilising advanced analytical and intelligence methodologies.

The resources available to target the activities of Organised Criminal Groups (OCG’s) include direct resources allocated to the Drugs and Organised Crime Bureau itself as well as indirect resources which include the services of specialist units as well as Divisional and District Drugs and Detective Units.

    Gabrielle McFadden (Longford-Westmeath, Fine Gael)
    194. To ask the Minister for Jobs, Enterprise and Innovation his views on establishing a proof house in Ireland, in view of the fact that, currently, any standard of non-military gun can be imported into the Irish market without sufficient quality control; that such a facility would be used for testing unproofed guns to make sure they are safe to enter the public domain; that it would also provide a central place for destroying and decommissioning old and worn out non-military guns; and if he will make a statement on the matter. [17527/15]
    195. To ask the Minister for Jobs, Enterprise and Innovation if consideration will be given to opening a proof house if there was a credible business person willing to manufacture non-military firearms; and if he will make a statement on the matter. [17528/15]
    196. To ask the Minister for Jobs, Enterprise and Innovation in view of the fact that the Firearms (Proofing) Act 1968 was introduced by the then Department of Industry and Commerce to set up a proof house, specifically for shotguns manufactured by an indigenous firearms company, if consideration will be given to setting up such a facility, if a suitable business proposal were submitted to his Department; and if he will make a statement on the matter. [17529/15]

Richard Bruton (Minister, Department of Jobs, Enterprise and Innovation; Dublin North Central, Fine Gael)

I propose to take Questions Nos. 194 to 196, inclusive, together.

I am not aware of any proposals being submitted to my Department to establish a Proof House for firearms in Ireland. I understand that Proof Houses are normally only established in States where firearms are manufactured. In that context, I understand that Ireland does not have any firearms’ manufacturers.

Such Proof Houses have been set up in a number of EU Member States which have firearms’ manufacturers. These Member States are signatories to the Commission Internationale Permanente pour l’epreuve des armes feu portatives ("Permanent International Commission for the Proof of Small Arms" – commonly abbreviated as C.I.P.) which is an international organisation which sets standards for safety testing of firearms. I, as Minister for Jobs, Enterprise and Innovation, have no proposals for Ireland to join the C.I.P.

The establishment of any such Proof House in Ireland would have security implications which would be a matter for the Minister for Justice and Equality. Overall responsibility for firearms importation into Ireland, and the licensing thereof, are also the responsibility of my colleague the Minister for Justice and Equality. In this context, I note that the Department of Justice and Equality application form for importation of firearms by a registered firearms’ dealer into Ireland includes a requirement to declare if the firearm has a C.I.P. proof status or not. I would remind the Deputy that the Department of Justice and Equality undertook a public consultation earlier this year in relation to the licensing of firearms in Ireland.

That brings me to the issue, related to discussion of the Bill, of guns in society. We need to examine this and to be vigilant. The Bill is important in that it targets those senior criminals who are making the money, but then it is important that the money is distributed to the people who have suffered as a consequence of these bully-boy antics. Many communities have been intimidated. Recently, I attended a number of meetings in my constituency about the fact that whole streets were being intimidated by a certain gang. One gang leader, together with around 20 or 30 young men, was spreading fear up and down those streets and the families were so intimidated they would not even dream of going near the Garda. They were telephoning local TDs such as myself and asking them to intervene and talk to the senior gardaí. We need to focus on that, because there is a significant element of society that is being marginalised and left out there on its own. When making these points, it is important that we say to those in middle Ireland who think drug-taking is acceptable in some way that they must accept responsibility as well, because the drug dealers will follow the market. If there is a market in the affluent Ireland for cocaine, the drug dealers will move into it and make money on the back of it. That needs to be said.

At present, the Oireachtas Joint Committee on Justice, Defence and Equality, of which I am a member, is doing a lot of valuable work, under Deputy David Stanton, on gangland crime in the community. We have held a lot of hearings. We have heard presentations from all the different voluntary groups, drugs groups, parents' groups and victims of crime, and we will be producing a comprehensive report. I hope the Minister will support the recommendations when that report is issued in either the summer or the autumn.

    ...

When talking about crime and the proceeds of crime, as I mentioned earlier, we also need to think about the issue of firearms. There is significant a public safety concern among broader society about the availability of firearms, both legal and illegal. According to recent research done by the Oireachtas Joint Committee on Justice, Defence and Equality, there are around 150,000 unregistered firearms. I am not talking about the responsible gun owners and the sensible people. I am talking about unregistered firearms. It is important to mention the threat to broader society. Between 2005 and 2008, 31 handguns were stolen and 1,236 other civilian firearms were stolen. Of the 1,236 firearms, only 373 were recovered. We need to be focused, and responsible gun owners need to be vigilant.
They need to be careful. We need strong regulation and commonsense when dealing with this issue because we have enough guns in the broader society, a fact which must be recognised.

    647. To ask the Minister for Arts, Heritage and the Gaeltacht the position regarding an alleged breach of the Wildlife Acts in February 2014 (details supplied) in Donabate in County Dublin; and if she will instruct the National Parks and Wildlife Service to report on the status of the complaint made. [18699/15]
    648. To ask the Minister for Arts, Heritage and the Gaeltacht the position regarding the transformer which was damaged, allegedly by a person (details supplied) in Donabate in County Dublin, in February 2015; and if she will instruct the Electricity Supply Board to report on the repair works required, including costs. [18700/15]

Minister for Arts, Heritage and the Gaeltacht (Heather Humphreys (Cavan-Monaghan, Fine Gael))

I propose to take Questions Nos. 647 and 648 together.

All birds, including the species referred to by the Deputy, are protected under the Wildlife Acts and the EU Birds Directive. However, the hunting of certain game birds, such as the species in question, is allowed at certain times of the year under the Open Seasons Order for Wild Birds. In addition, the shooting of that species is allowed under an annual Declaration made under the European Communities (Wildlife Act, 1976) (Amendment) Regulations 1986 (SI No 254 of 1986), which permits the capture or killing of certain birds to prevent serious damage to arable crops or to public health.

My Department is aware of allegations of illegal hunting last year in the area referred to by the Deputy. I understand that Final County Council, An Garda Síochána and the National Parks and Wildlife Service of my Department have had discussions to consider this matter.

I have no information regarding alleged damage to a transformer.

    129. To ask the Minister for Justice and Equality the position regarding the review of firearms legislation; and if she will make a statement on the matter. [19058/15]

The Oireachtas Committee on Justice, Defence and Equality also sought submissions and held hearings with interested parties in relation to the Working Party report and published an interim report on the matter.

As part of the process of consultation I gave a commitment that I would not make any decisions until I had met the key stakeholders, including the organisations who represent those who use firearms for sporting purposes. I had a useful meeting with the key stakeholders on 29 April 2015 and consideration of the issues involved is continuing.

    259. To ask the Minister for Justice and Equality the requirements that have to be met to possess a licence to hold a gun; when a person is refused the issuing of a gun licence, the conditions that have to be met the application is to be reconsidered.; and if she will make a statement on the matter. [19748/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I can inform the Deputy that Section 3 of the Firearms Act 1925 as amended, provides that an application for a firearm certificate shall be made to the Superintendent of An Garda Síochána of the District in which the applicant resides. An application for a restricted firearm certificate is made to the Commissioner who has delegated this responsibility to members of An Garda Síochána holding the rank of Chief Superintendent. Section 4 of the 1925 Act, as amended, provides the conditions to be satisfied prior to an issuing person granting a firearm certificate. The conditions include having a good reason for requiring the certificate, granting the certificate will not endanger public safety, security or the peace, the person is not disentitled to hold a firearm certificate and that secure accommodation for the firearm has been provided. Further information may also be sought from the applicant by an issuing person including proof of identity, proof of competence in the use of the firearm concerned, a requirement to provide details of his/her medical history and providing two referees to attest to the applicant's character.

If an applicant is refused a certificate by an issuing person, the applicant must be provided with reasons for such refusal in writing. The applicant can then appeal the refusal, under Section 15A of the Firearms Act 1925 as amended, to the District Court within 30 days of receiving the refusal letter.
The District Court can confirm the decision of the deciding officer, or direct that person to reconsider the decision, or allow the appeal where the issuing person shall give effect to the Court's decision.

If a person reapplies for a firearm certificate, the application shall be considered by an issuing person under the legislation as outlined above. Each application is always considered on its own individual merits in accordance with law.

    Alex White (Dublin South, Labour)
The collection of firearms licence fees by An Post on behalf of the Department of Justice, Equality and Defence is a day to day commercial matter for An Post and not one in which I have a function. The question is more appropriate to the Department of Justice, Equality and Defence which has responsibility for firearms licences.

    475. To ask the Minister for Justice and Equality the amount of revenue collected in respect of firearms licence fees in each of the years 2012 to 2014; and if she will make a statement on the matter. [28981/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I am informed by An Garda Síochána that the total revenue collected by them in respect of firearm licence fees in 2012, 2013 and 2014 is as follows: 2012, €1.926m; 2013, €10.755m; and 2014, €3.697m.
These figures include revenue for fees for firearms certificates issued to non- residents in accordance with the Firearms (Firearms Certificates for Non-Residents) Act 2000. It should be noted that as the certificate renewals cover a 3 year period, the level of receipts will therefore diminish over the course of the 3 year renewal cycle.

    962. To ask the Minister for Arts, Heritage and the Gaeltacht her views on whether the banning of the sale of migratory species will significantly remove the motivation and/or incentive for their commercial exploitation; and if she will make a statement on the matter. [29175/15]

Seán Ó Fearghaíl (Kildare South, Fianna Fail)
    963. To ask the Minister for Arts, Heritage and the Gaeltacht whether she believes there is already significant precedent for banning the sale of migratory species, such as Statutory Instrument No. 228 of 1992 banning the sale of the curlew, and Statutory Instrument No. 241 of 1982 banning the sale of goldeneye ducks; and if she will make a statement on the matter. [29176/15]

    Heather Humphreys (Cavan-Monaghan, Fine Gael)

I propose to take Questions Nos. 961 to 963, inclusive, together.

My Department is aware of concerns expressed by a number of organisations relating to the apparent increase in the hunting of certain migratory birds, including woodcock. I intend to hold a short consultation with relevant stakeholders on options to address concerns about woodcock to ensure their views are known to my Department on this matter. There is already legislation in place banning the sale of certain wild birds such as curlew, goldeneye and gadwall.

My officials will examine the options arising out of this consultation with a view to affording increased protection as appropriate to woodcock populations. I am conscious that the next hunting season for woodcock starts on 1 November. I would aim to have any necessary change in place by that time.

    391. To ask the Minister for Justice and Equality her views on correspondence (details supplied) regarding firearms legislation; and if she will make a statement on the matter. [30167/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

The Deputy has raised a number of questions in relation to the accuracy of statistics on stolen firearms provided from the PULSE system and the impact of this in relation to decision making. The Deputy will be aware that following a detailed analysis of PULSE data in relation to the recording, classification and reclassification of crime, the CSO has recently resumed publication of the quarterly crime figures, along with an analysis of how the issues identified in the Garda Inspectorate Report on Crime Investigations impact on the production of these statistics. The analysis carried out by both the CSO and the Garda Inspectorate has identified common issues of concern in relation to Garda crime recording processes and systems. A significant number of these relate to ICT issues and some of them are specifically in relation to PULSE.

The Garda Commissioner has taken a number of steps to respond to the concerns identified in the Inspectorate report, including the establishment of a new Data Quality Team in the Garda Information Services Centre (GISC), as well as measures to strengthen PULSE governance arrangements. These measures form part of broader steps to take forward the Inspectorate’s recommendations, including plans to upgrade and improve the technology for recording of crime and policing activity.

The compilation and publication of crime statistics is a matter in the first instance for the Central Statistics Office, as the national statistical agency. The expert panel will review the crime counting and detection rules, as recommended by the Inspectorate, with a view to introducing new national standards

On the question of compensation and the possession of a firearm being a privilege, I wish to refer the Deputy to Section 13 of the Working Group report on the Review of Firearms Licensing which was published in November 2014.

    To quote from section 13:
"In Magee V Murray (2008, Judge Birmingham) it is stated in summary: “The possession of every firearm is illegal unless authorised by law. The possession of a firearm is not a right, but it is a privilege...”.

A similar view was expressed in McCarron V Kearney by Charleton J. (High Court, 4 July 2008)."

Section 13 also notes that the Courts have taken the view that what is in the State’s gift cannot be required to be compensated if it is withdrawn. For example, in Gorman v Minister for the Environment (2001, Judge Carney) it was held that the absence of compensation for permitting the issuance of taxi licences to anyone qualified was constitutional.

Finally, insofar as consultation with the Attorney General in relation to legislative changes is concerned, I can confirm to the Deputy that any legislative changes are subject to consultation with the Attorney General.

I think they're trying to say that if they ban licencing of classes of firearms, they don't have to compensate anyone, the way that nobody was compensated for '72. You'd still own the firearm, you just couldn't possess it.

Whether or not that would survive ten minutes in a courtroom hearing the first in a series of several hundred cases all arguing that the loss in value caused by deflating the market value of those firearms, plus the lost sunk cost into legally mandatory things like upgraded house security, gunsafes, permanent modifications to cars and so forth, is another matter.

Either way, the state would still be facing long, expensive court rows and negative publicity in the run-up to both a General Election and a celebration of the 1916 rising. Somehow I don't think they want to go down that road unless some rather stupid people on our side give them a good hard shove in that direction.

    Gabrielle McFadden (Longford-Westmeath, Fine Gael)
    529. To ask the Minister for Justice and Equality the average time it takes for the firearms section of her Department to process applications for import and export licences for non-military firearms; if she is satisfied that there is sufficient staff to process such applications; and if she will make a statement on the matter. [37333/15]

    530. To ask the Minister for Justice and Equality her views on the concerns of a company (details supplied) regarding delays in the processing of applications for licences to import and export non-military firearms for its hunting and fishing business; and if she will make a statement on the matter. [37334/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I propose to take Questions Nos. 529 and 530 together.

I can inform the Deputy that there are no delays in processing application forms for import and export licenses for firearms and/or ammunition within my Department. The time taken to process an application to finality can be prolonged by the lodging of incorrect information by the applicant. When incorrect information is provided by an applicant, the matter is dealt with expeditiously by the staff in my Department in accordance with the Department's customer service policy and the applicant is contacted and advised to re-submit correct information.

As a general rule, applications are processed within 10 working days and in many instances in a lesser period. The recent postal strike may have led to delivery of licences later than usual.

    Bobby Aylward (Carlow-Kilkenny, Fianna Fail)

    566. To ask the Minister for Justice and Equality if she will consider appointing appropriate representatives from national shooting sports organisations such as the National Sports Coalition to the new firearms and appeals authority, which is due to be established, to ensure a reasonable and rational approach to shooting sports activities; and if she will make a statement on the matter. [37742/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I recently announced fundamental long term reforms of firearms licensing including the establishment of a new Firearms Assessment and Appeals Authority. The primary function of the Authority will be to determine, on the basis of an objective assessment of all the issues, with safety of the public being paramount, whether particular forms of firearms may be licensed in the State, whether there should be any limit on the number of such firearms and what safety conditions might properly be applied to their licensing. The functions of the Authority will be subject to further consultation with key stakeholders in advance of the preparation of the necessary enabling legislation, which will be subject to pre-legislative scrutiny by the Joint Oireachtas Committee on Justice, Equality and Defence. I have also sought submissions on the proposed Authority from the Firearms Consultative Panel, which is made up of key stakeholders, including the Sports Coalition. Accordingly, it is premature at this stage to decide on the make up of the Authority before the consultation process.

    337. To ask the Minister for Justice and Equality the status of the review of firearms licensing legislation: if the concerns of the National Association of Regional Game Councils and the Sports Coalition have been given detailed consideration; and if she will make a statement on the matter. [39613/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I can advise the Deputy that I recently announced a series of changes to the licensing of firearms. My announcement followed an extensive consultation process with key stakeholders and hearings by the Joint Oireachtas Committee on Justice, Equality and Defence on a report from a Joint Garda Síochána/Department of Justice and Equality Working Group published in November 2014. The changes announced will address issues in the short term but also map out the longer term future for a licensing system which balances the rights of those who wish to pursue their interests with public safety, which has to be the paramount consideration. I understand the Sports Coalition (of which the National Association of Regional Games Council is a member) has welcomed and fully endorsed my announcement.
My intention is to make fundamental long term reforms in this area by proposing legislation for a Firearms Assessment and Appeals Authority.

As part of the review process, I announced my intention to re-establish the Firearms Consultative Panel. The re-established panel had their first meeting on 29 October 2015. It is made up of key stakeholders, including the Sports Coalition. This panel provides a valuable forum for contact and discussion between my Department and representatives of shooting organisations, An Garda Siochana and other interested parties. I have sought submissions from the Firearms Consultative Panel on a number of issues affecting licensed gun owners including the proposed Firearms Assessment and Appeals Authority. I look forward to building on the positive relationships developed between representative organisations and my Department during the review of firearms licensing and I look forward to continued open and positive dialogue with all representative organisations.

I have notified the Garda Inspectorate that I intend to ask them to review the administration of firearms licensing by An Garda Síochána when the Firearms Assessment and Appeals Authority is in place for a period of 12 months.
I have introduced an immediate temporary cap on the licensing of any new centre-fire semi-automatic rifles pending the establishment and determination of the Authority. Legislation will provide for the revocation of any licenses issued before the enactment of the legislation and it is intended that anyone applying for licenses of this nature will be informed of that fact.
I have signed secondary legislation re-defining what constitutes a non-restricted handgun. The purpose of this legislation is to ensure persons who currently hold licences for handguns will be able to reapply for a license in the current licensing round. This legislation clarifies for An Garda Síochána what firearms may be considered by them for licensing.

In line with my commitment to prevent any proliferation of handgun availability in Ireland, I am continuing to monitor the number of 0.22 inch rim fire calibre handguns being licensed. If there is a significant increase in the number of applications for new certificates or import licence applications for these handguns, I will introduce priority legislation for a future cap.
Finally, the Garda Commissioner intends to establish a centralised licensing system for restricted firearms, pending the establishment and determination of the Firearms Assessment and Appeals Authority. The Garda Commissioner is preparing a detailed outline of the proposed work of the centralised licensing system for my consideration.

And an excerpt from a Joint Committee meeting with the Garda Commissioner on November 11:
Alan Farrell (Dublin North, Fine Gael)
This is my second time around. I have a question on drugs and firearms for the Commissioner. My question is specific to the proliferation of firearms and their availability. More specifically, this afternoon Mountjoy Prison is currently in lock-down as a result of the discovery of a quantity of weapons in a restricted area of the prison.

Finian McGrath (Dublin North Central, Independent)
    Did that happen today?

Alan Farrell (Dublin North, Fine Gael)
Today, as we speak. The committee has done a great deal of work on the issue and made proposals on the firearms licensing regime. The Chairman has spent a great deal of time working on the project along with Deputy McGrath. The proposed licensing authority is independent of An Garda Síochána. Will the authority be more of a consultative body rather than an administrative function for the force? Does the Commissioner believe that the new authority will speed up the licensing of firearms and ensure that we have quality control for licensed firearms that are licensed in this country? Will the initiative free up resources to allow An Garda Síochána tackle illegal firearms and weapons that are in the public domain?

    Ms Nóirín O'Sullivan:
An important distinction must be made. They are two separate things. In terms of firearms licensing, the centralised authority is a very welcome initiative in so far as it will provide consistency in decision-making around the application of the granting or otherwise of firearms licences. I would not like to give the committee the impression that we are suggesting, in any way, that licensed firearms are the same.

Alan Farrell (Dublin North, Fine Gael)
I hope I made that distinction.

    Ms Nóirín O'Sullivan:
Yes, I thank the Deputy. The proliferation of what I call illegal firearms tend to be around organised crime, criminality and dissident activities. That is important to mention. The new firearms licensing regime will certainly help greatly. It does not free up a lot of Garda resources because previously, and historically, the job was done by district officers. The district officer will still have an input into the assessment of individuals but added value comes from the centralised decision-making and the consistency of same.

    310. To ask the Minister for Justice and Equality if she has considered a firearms amnesty in relation to various persons who have unlicensed guns, to give them the opportunity to hand the guns over and thereby reduce the number of weapons in circulation, given crime levels; and if she will make a statement on the matter. [41190/15]

Frances Fitzgerald (Minister, Department of Justice and Equality; Dublin Mid West, Fine Gael)

I can advise the Deputy that An Garda Síochána tackles the issue of illegal firearms on a daily basis at both local and national levels through a range of targeted and intelligence based operations, often disrupting and preventing incidents, as well as detecting and prosecuting those involved.

Heavy penalties are provided for weapons offences in our criminal law and mandatory minimum penalties have been introduced for certain firearms offences. The considerable powers already available to Gardaí are now supplemented further by the DNA Database system which went live last week and which has the capacity to link suspects to unsolved crimes using forensic evidence, and will greatly assist Gardaí in investigating a whole range of serious offences.

I am not convinced at this stage that some form of firearms amnesty would make a useful contribution to the reduction of gun crime. There was such an arrangement for a two month period in late 2006 but that was in the context of new licensing arrangements being introduced and represented an opportunity for people to regularise their situation before the heavier penalties provided for in the legislation came into force. It is doubtful that such an amnesty would result in hardened criminals handing up weapons. Equally, I am not convinced it is desirable to allow people who hold firearms illegally to evade the legal consequences for that. Nevertheless, I will keep this matter under review.

Election in the wind, TD starts making noise to get himself noticed.
    How predictable.
Hopefully shooting sports people in his constituency start to lobby him in a sustained manner.

The last time this specific TD did that, it led to the 2009 Misc. Provisions version of the Act and the de facto banning of centerfire pistols and nearly the banning of all pistols.
