    And presumably crossbows, silencers, etc, etc, etc...

    It seems bizarre when 1700 firearms are reported as stolen nearly 500 are "other"

    351. To ask the Minister for Justice and Equality the position regarding plans to review firearms licensing; and if she will make a statement on the matter. [9286/15]

    In light of public safety concerns highlighted by An Garda Síochána, a joint Department of Justice and Equality/ An Garda Síochána Working Group was established by the Department of Justice and Equality to review firearms licensing. The report of this Working Group was published on 13 November 2014 and submissions on the report were sought from stakeholders and the public by 31 January 2015. The consultation process gave individuals and groups an opportunity to contribute to the development of firearms policy and legislation and will enable consideration to be given to the future direction of such legislation.

    The submissions received are currently being examined and incorporated into a report for me. The Oireachtas Committee on Justice, Defence and Equality has also sought submissions and held hearings with interested parties in relation to the Working Party report. It is expected that their report on the issue will be available shortly.

    I have already given a commitment that I will not make any final decisions until I have considered all the submissions which have been made and have met the key stakeholders, including the organisations who represent those who use firearms for sporting purposes. These meetings will take place following receipt and consideration of both my Department’s and the Oireachtas Committee reports.

To ask the Minister for Justice and Equality in view of the report by the Garda of some 1,700 firearms reported stolen, in the years 2010 to 2014, which includes 17 handguns and 40 air pistols, the number of those 17 handguns which were licensed to firearms licence holders at the time of the theft; and the number stolen from the licence holders’ homes; and if she will make a statement on the matter.     I propose to take Questions Nos. 331 to 342, inclusive, together.

    The Deputy's questions relate to information provided by An Garda Síochána in response to Parliamentary Questions seeking information regarding the numbers of firearms reported stolen over the past five years. The figures relate to licensed and unlicensed firearms stolen over the period, including those stolen from Firearms Dealers. The information from the Garda PULSE system which was used to compile this information follows. This information from PULSE cannot be amended or updated for statistical purposes. As indicated in response to the Deputies the total figure for firearms stolen of 1,710 between 2010 and 2014 includes 483 items in the category of Other, which includes humane killer, starting gun and blank firing gun.

    I note some of the Deputy's questions relate to firearms stolen from licensed owners and how many of these guns stolen may, for example, be replicas or humane killers or deactivated firearms.

    The table below gives details of firearms linked to a licence recorded as stolen over the years 2010 to 2014 inclusive, with yearly totals for rifles, shotguns and handguns.

    The research required to compile the other information sought by the Deputy would require a disproportionate expenditure of time and resources, which cannot be justified in current circumstances where there are other significant demands on resources.

    It's hard to point to any one PQ over the last few years and say "This one is the most significant", but this is definitely a contender for the sheer amount of raw data it's made available. (So I put it in a spreadsheet, attached to this post. Enjoy)

    Interesting that Gun Safes are classed as firearms in the statistics, There also seems to be 105 instances of cartridge thefts totaling 266 rounds. :(

    Just thinking the same.

    Scopes are firearms? No license needed, not even authorisation.

    Toy gun, imitation gun, paintball gun. All classed as firearms stolen yet none require a license (regardless of the legal standing of paintball guns).

    Once again we see the statement of "It'll cost too much" when asked about other statistics. My point would be if you cannot be bothered to get the stats (other than it meaning you don't have them) then how can any statement in relation to those items be considered as relevant, accurate or even legally be allowed to be said as it'd be best guess. IOW a pure guess.

    I know, but as i said above they are not making them license them so it's either a firearm or not. It cannot be a firearm when using it as a stick to beat us with about stolen firearm numbers, and then let the weekend warriors run around shooting each other with illegally held, restricted firearms without batting an eyelid.

    I thought that night vision and thermal scopes need permission but aren't actually regarded as firearms under the law?

    Am I wrong?

    In the section 1 definition:
    (i) telescope sights with a light beam, or telescope sights with an electronic light amplification device or an infra-red device,

    So technically, it could be valid.
    I'd be surprised if it was though.

    Sure looks like some were counted twice allright... and even three or four times if they counted the safe and ammo, but they're not legally firearms.

    A scope is not a firearm, even if it's IR, NV, Laser designator, etc. and it's not a component part of the firearm as the firearm will function perfectly fine without it. It only requires authoirsatiion if it is IR/NV, etc. and going to be fitted to a firearm.

    (i) telescope sights with a light beam, or telescope sights with an electronic light amplification device or an infra-red device, designed to be fitted to a firearm specified in paragraph (a), (b), (c) or (e)
    Namely:
    (a) a lethal firearm or other lethal weapon of any description from which any shot, bullet or other missile can be discharged;

    (b) an air gun (which expression includes an air rifle and an air pistol) or any other weapon incorporating a barrel from which metal or other slugs can be discharged;

    (c) a crossbow;

    (e) a prohibited weapon as defined in section 1 (1) of the Firearms Act, 1925 ;

    Yeah, but if you get a scope designed to be fitted to a rifle and it has a light attached to it, you could legally call it a firearm. You'd have to be hugely under-utilised as a Garda to do so, but you technically could.

    Gun safes, ammunition and toy guns and imitation guns on the other hand, legally are not firearms and yet I suspect these figures were presented by AGS to the Dail as being the number of stolen firearms.

    I think that an AGS officer presenting data that wonky to the Oireachtas does kindof raise a question or two... which is why I'm ignoring even the really edge cases of what might be a firearm and looking only at the stuff that specifically cannot be one.

    I understand and appreciate where you're coming from and my questioning is more so to highlight the incompetence of the AGS/DoJ and the law itself.

    If i buy a NV scope i can do so without a firearm or firearms license. The only legal issue comes around when i attach it to a firearm. Then it falls under section 4(2)(g)(i) as a component part.

    No, you can buy an NV monocular or something not designed to go on a firearm. If it's designed to go on the firearm it becomes a firearm under the law, regardless of whether or not it's ever attached to on.

    And yeah, this law's an ass all day long...

    As long as iv'e being doing this i never knew that. So you buy a NV scope, have no firearm, and no firearms license and you're in breach of the firearms Act/1990 offensive weapons act?


    Anyone know where there is a good ring because i've a towel to throw. I mean in the face of that how can you expect to make rational arguments with those that write, and pass these laws?

    That's not even the worst part.

    There are two conflicting definitions for firearm in Irish law. One in the Firearms Act, one in the Criminal Justice Act 2001. There's no definition for target shooting anywhere in the law. But possession of the former or taking part in the latter outside of a range, is an offence under the law that can carry a jail sentence as punishment.

    I propose to take Questions Nos. 312 and 342 to 344, inclusive, together.

    The Firearms (Proofing) Act 1968 was introduced by the then Department of Industry and Commerce (now the Department of Jobs, Enterprise and Innovation (DJEI), to set up a proof house specifically for shotguns manufactured by an indigenous firearms company that was being part-funded by State Aid. I understand the gun company subsequently went into liquidation and the proof house at the Institute for Industrial Research Standards (IIRS) - the predecessor to the National Standards Authority of Ireland (NSAI) - ceased to function at the same time.

    Firearms proofing is a safety matter with regard to the production and use of a firearm and is normally carried out at the point of manufacture. To establish a proof house in Ireland is a matter ultimately for the Minister for Jobs, Enterprise and Innovation. Such a measure would only be viable if there was a domestic manufacturer of firearms.

    Many firearms imported into Ireland come from the 14 countries which are members of the Commission Internationale Permanente pour l'épreuve des armes à feu portatives (CIP). This means the firearms produced in those countries have a CIP proof mark, which essentially relates to a common standard for mutual recognition of proof marks. Countries such as America and Canada are not members of CIP and their manufacturers test and proof mark their firearms according to their own standards. Firearms from these non CIP countries are imported into Ireland. Responsibility concerning product safety of firearms is a matter for manufacturers, the individual consumer and the firearms dealer who imports firearms. Many EU countries, including Ireland, do not have domestic firearms production, and are not members of the CIP. In the absence of sector specific EU legislation on the product safety of firearms, the product and consumer safety issues relating to firearms fall under the General Product Safety Directive (GPSD) 2001/95/EC of the European Commission. The responsibility for the implementation of this Directive (including related market surveillance and enforcement issues) rests with my colleague, the Minister for Jobs, Enterprise and Innovation.

Deputy Catherine Murphy asked the Minister for Justice and Equality if her attention has been drawn to the fact that some considerable doubt has been cast over the accuracy of statistical crime data prepared by An Garda Síochána for the Central Statistics Office; if she has read the Garda Inspectorate's recent report, which uncovered evidence of actual crimes being reclassified as non-crimes; her views on the significant problems that inaccurate crime data will have for effective policing and deployment of resources; the steps she will take to address this serious matter; and if she will make a statement on the matter.     I can assure the Deputy that I am familiar with the Garda Inspectorate Report's analysis of the issues she refers to and welcomed its examination of these matters on publication. As the Inspectorate report recognises, these issues have been reported in other police services and the Inspectorate's recommendations draw from measures introduced in those jurisdictions.

    It is of course of great importance that police data is as accurate as can be and this is reflected in the steps taken by the Garda Commissioner to respond to the concerns identified in the Inspectorate report, including the establishment of a new Data Quality Team in the Garda Information Services Centre (GISC), as well as measures to strengthen PULSE governance arrangements. These measures form part of broader steps to take forward the Inspectorate’s recommendations, including plans to upgrade and improve the technology for recording of crime and policing activity.

    In so far as the compilation and publication of crime statistics is concerned, this is a matter in the first instance for the Central Statistics Office, as the national statistical agency. The CSO is currently carrying out a detailed analysis of certain issues raised by the Inspectorate in relation to the recording, classification and reclassification of crime, to see whether and to what extent they may have implications for the crime statistics which that Office produces. I understand that substantial work has been carried out on this project since the report's publication, and that this work is ongoing.

    In addition, the CSO has also agreed to chair an expert panel to examine the Inspectorate's recommendations on crime statistics. The expert panel will review the crime counting and detection rules, as recommended by the Inspectorate, with a view to introducing new national standards. I am advised that the expert panel will commence its work in the coming weeks.

    This isn't specifically to do with us, but given the stuff that turned up in the 1700 stolen firearms statistic...

    The Deputy refers to the increasing number of unlicensed firearms in the State. It is however impossible to accurately state how many illegal firearms are currently in the hands of criminals in the State or whether this figure is increasing. An Garda Síochána tackles the issue of illegal firearms on a daily basis at both local and national levels and in recent weeks alone have successfully removed a number of illegal firearms from criminal hands in ongoing operations throughout the country.

    Gardaí tackle the issue of illegal firearms through a range of targeted and intelligence based operations, often disrupting and preventing incidents, as well as detecting and prosecuting those involved.

    Heavy penalties are provided for weapons offences in our criminal law and mandatory minimum penalties have been introduced for certain firearms offences. The considerable powers already available to Gardaí have been supplemented further by the DNA Database legislation enacted last year, which provides for the establishment of a Database which will have the capacity to link suspects to unsolved crimes using forensic evidence, and will greatly assist Gardaí in investigating a whole range of serious offences.

    The various Garda operations which target armed and organised criminals are complemented and supported by Garda engagement with local communities, including a range of community local fora, to address local concerns relating to crime, community safety and the impact of organised crime on community life.

    The Deputy also refers to what is described as incorrect information provided to Oireachtas members regarding the number of licensed firearms stolen. The statistics provided by An Garda Síochána regarding firearms reported stolen is provided on the basis of data available on the PULSE system. The data available cannot be amended or updated for the purposes of providing statistics. I can also inform the Deputy that different types of questions were asked by Oireachtas members in relation to stolen firearms. One set of figures provided, totalling 1,710, was for all firearms reported stolen between 2010 and 2014. This figure would include firearms not licensed stolen from firearms dealers and other items classified as firearms such as humane killers, starting guns and blank firing guns which would be held on authorisation rather than licence. Another set of figures provided, totalling 1,109, was for all firearms linked to a licencerecorded as stolen between 2010 and 2014.

    I understand the Deputy is referring to a recent Prime Time programme which had a report on firearms licensing. The Deputy will appreciate that I have no role in adjudicating on whether broadcasting codes or rules have been broken.
    However, I am advised that under the Broadcasting Act 2009, viewers and listeners can complain about broadcasting content which they believe is not in keeping with broadcasting codes and rules. In line with the complaint process, the viewer or listener should direct their complaint to the broadcaster in the first instance with regard to the broadcaster's Code of Practice for Handling Complaints, a document which each broadcaster has available on its website. If a viewer or listener is not satisfied with the response from the broadcaster or if the broadcaster does not respond within the timeframe provided for in their Code of Practice (usually 21 days), then the viewer or listener can refer the complaint to the Broadcasting Authority of Ireland for consideration.

The consultation process gave individuals and groups an opportunity to contribute to the development of firearms policy and legislation and will enable consideration to be given to the future direction of such legislation. The submissions received are currently being examined and incorporated into a report for me.

    The Oireachtas Committee on Justice, Defence and Equality has also sought submissions and held hearings with interested parties in relation to the Working Party report and will publish its own report on the matter. I have already given a commitment that I will not make any decisions until I have met the key stakeholders, including the organisations who represent those who use firearms for sporting purposes.

    Sparks you made a mistake. You pasted the minister's response to Terence Flanagan as her response to Fergus McLoughlin. Oh wait, you didn't. She gave the exact same response. Word for word to both deputies. Same as her response to Jerry Buttimer. How can she be allowed to repeat the same non sensical answer as though it was an answer?

    Niall Collins in there again with a very direct and precise question (wonder where he got the idea from :D). I notice there was no "scripted" response to that question. Be interesting to see what reply he gets, if any, considering it took six months to get an answer to the numbers question and even that was balls-ed up.


    One thing that does annoy me, In her "copy and paste" reply the Minster says that An Gardaí have considerable powers, endless legislation, DNA database, etc. to tackle gun crime. If the law so appropriately covers all eventualities then:
    • Why are they seeking further restrictions?
    • If they are so successful in removing illegal guns "from the streets" then why the need to remove ours?
    • If no number can be given why are An Gardai and the likes of McGrath allowed to spout 150,000 as though it were fact?
    • Why can they not just say "we don't know" and leave the guessing out of it?
    • Why did the Minster quote PULSE as though it were some sort of impeccable source when the Garda Inspectorate, and all shooting groups, have shown the system to be wholly outdated and severely lacking when it comes to recording accurate information as well as referencing for statistics.

    Deputy Gabrielle McFadden asked the Minister for Justice and Equality the average length of time it takes her Department to process import and export licences for non-military guns; the criteria required for an applicant to secure a continuous export licence; and if she will make a statement on the matter.     My Department takes, on average, 10 working days to issue an import / export licence for firearms. Firearms Dealers registered with my Department routinely apply for transfer documents / export licences to remove specific firearms from Ireland to another jurisdiction within the EU. The Department of Jobs, Enterprise and Innovation process applications to export firearms to Non EU countries.

    The main legal provisions governing the export and removal of firearms from the State are Section 16 of the Firearms Act, 1925 and Regulation 6 of the EC ( Acquisition and Possession of Weapons and Ammunition) Regulations 1993, as amended. In effect, this means that a firearms dealer exporting firearms must obtain a removal order from the relevant Garda Superintendent for the specific firearms being removed and then an application can be made to my Department for a transfer document/ export licence. This requirement of a removal order applies to both specific export licences and a Continuous Export Licence (CEL). An application for a CEL is judged on its merits. A CEL is issued in exceptional circumstances to a very limited number of dealers who have high volumes of trade within the EU for a period not exceeding three years.

    As the Deputy will appreciate, the Garda Commissioner is responsible for the distribution of personnel, among the Garda Regions, Divisions, and Districts. Garda management keep this distribution under continuing review in the context of crime trends and policing priorities so as to ensure that the best possible use is made of these resources.

    The An Garda Síochána Policing Plan for 2015 sets out the continued commitment of An Garda Síochána to pro-actively target groups and individuals engaged in serious crime in all its forms, in particular violent crime and organised criminal activity. Members of An Garda Síochána continue to utilise all available legislation, including the additional legislative provisions introduced by the Oireachtas in 2009 which amended the Criminal Justice Act, 2006 relating to organised crime.

    Europol have identified the need for a community wide approach to help tackle Organised Crime Groupings including law enforcement, customs, business interests and government policy. An Garda Síochána are acutely aware that the targeting of Organised Criminal Groupings is best advanced by using multi-disciplinary approaches to ensure the activities of individuals and groups are effectively targeted. This includes the use of the Proceeds of Crimes Legislation including money-laundering legislation and the powers of the Criminal Assets Bureau.

    An Garda Síochána also interact with a number of other law enforcement agencies from outside the jurisdiction in the ongoing combating of drugs and firearms trafficking and organised crime on an international level.

    Taking cognisance of the target focused operations of both the Organised Crime Unit and the Garda National Drug Unit and the strength that could be gained from combining resources, the Commissioner decided to merge the Organised Crime Unit and the Garda National Drug Unit to create a robust entity, the Drugs and Organised Crime Bureau to effectively tackle organised crime as it currently exists in this country.

    The newly amalgamated unit will benefit from the skill sets of both the Organised Crime Unit and the Garda National Drug Unit personnel, in establishing an enforcement and investigative unit which will manage national and international drug trafficking and organised crime investigations.

    Organised crime is often transnational in nature, constantly evolving and diversifying to take advantage of the prevailing economic and social conditions; developments in technology; and increasing mobility at a global level. An Garda Síochána continues to develop and implement operations and strategies aimed at targeting, dismantling and disrupting criminal networks, utilising advanced analytical and intelligence methodologies.

    The resources available to target the activities of Organised Criminal Groups (OCG’s) include direct resources allocated to the Drugs and Organised Crime Bureau itself as well as indirect resources which include the services of specialist units as well as Divisional and District Drugs and Detective Units.

To ask the Minister for Jobs, Enterprise and Innovation his views on establishing a proof house in Ireland, in view of the fact that, currently, any standard of non-military gun can be imported into the Irish market without sufficient quality control; that such a facility would be used for testing unproofed guns to make sure they are safe to enter the public domain; that it would also provide a central place for destroying and decommissioning old and worn out non-military guns; and if he will make a statement on the matter.     I propose to take Questions Nos. 194 to 196, inclusive, together.

    I am not aware of any proposals being submitted to my Department to establish a Proof House for firearms in Ireland. I understand that Proof Houses are normally only established in States where firearms are manufactured. In that context, I understand that Ireland does not have any firearms’ manufacturers.

    Such Proof Houses have been set up in a number of EU Member States which have firearms’ manufacturers. These Member States are signatories to the Commission Internationale Permanente pour l’epreuve des armes feu portatives ("Permanent International Commission for the Proof of Small Arms" – commonly abbreviated as C.I.P.) which is an international organisation which sets standards for safety testing of firearms. I, as Minister for Jobs, Enterprise and Innovation, have no proposals for Ireland to join the C.I.P.

    The establishment of any such Proof House in Ireland would have security implications which would be a matter for the Minister for Justice and Equality. Overall responsibility for firearms importation into Ireland, and the licensing thereof, are also the responsibility of my colleague the Minister for Justice and Equality. In this context, I note that the Department of Justice and Equality application form for importation of firearms by a registered firearms’ dealer into Ireland includes a requirement to declare if the firearm has a C.I.P. proof status or not. I would remind the Deputy that the Department of Justice and Equality undertook a public consultation earlier this year in relation to the licensing of firearms in Ireland.
