Contesting Alleged Traffic Violation

    I was pulled over this evening just after coming through a junction. I hadn't done anything wrong but the Gard insisted that I'd driven through a red light. I hadn't.

    I didn't argue it with him there and then - except to say once that I didn't break the lights.

    He told me I'd receive a fine in the post and 3 penalty points.

    I don't deserve this as I didn't do anything wrong. But i don't have the first clue as to how to go about challenging this.

    I've never been to court before and I'm worried that if it simply comes down to my word against the garda's, the judge will just believe him and not me.

    Would appreciate any advice.

    The only advice that can be given is to contact a solicitor

    I think of your turning up in court basing your appeal on “my word against his” then you may likely leave court with double fine and points.

    What exactly are you going to say to convince the judge you are right ??

    I think the judge is likely to take the word of a guard over you. I mean it’s not like the judge will never have heard the “but I didn’t do it” defence before.

    If you’ve dashcam or cctv footage that would support your position then I would say definitely, otherwise I’d be asking are tue consequences of loosing not too high. Appealing and loosing will result in increased points and fine.

    Well that's the problem. I have no proof. But it's completely unfair to be just handed a fine and points.

    All I can say to convince the judge is "i didn't doo it". I have no other evidence.
